4. Any person who submits a tender shall fill up the usual printed form stating at what<br />
percentage above or below the rates specified in Schedule B (Memorandum showing items of<br />
work to be carried out) he is willing to undertake the work. Only one rate or such percentage<br />
on all the Estimated rates/Schedule rates shall be stated. <strong>Tender</strong>s, which propose any<br />
alteration in the works specified in the said form of invitation to tender, or in the time allowed<br />
for carrying out the work, or which contain any other conditions will be liable for rejection. <strong>No</strong><br />
printed form of tender shall include a tender for more than one work, but if contractor wishes<br />
to tender for two or more works, he shall submit a separate tender for each work. <strong>Tender</strong> shall<br />
have the name and number of the work to which it refers written outside the envelope.<br />
5. The Superintending Engineer or his duly authorized Assistant shall open tenders in the<br />
presence of contractors who have submitted tenders or their representatives who may be<br />
present at the time, and he will enter the amounts of the several tenders in a comparative<br />
statement in a suitable form. In the event of a tender being accepted, the contractor shall for<br />
the purpose of identification, sign copies of the specifications and other documents mentioned<br />
in Rule 1. In the event of tender being rejected, the Divisional officer shall authorize the<br />
Treasury Officer concerned to refund the amount of the earnest money deposited to the<br />
contractor submitting the tender, on his giving a receipt for the return of the money.<br />
6. The officer competent to dispose of the tenders shall have the right of rejecting all or any of<br />
the tenders.<br />
7. <strong>No</strong> receipt for any payment, alleged to have been made by a contractor in regard to any<br />
matter relating to this tender or the contract, shall be valid and binding on Government unless<br />
it is signed by the Executive Engineer.<br />
8. All work shall be measured net by standard measures and according to the Rules and<br />
customs of the Public Works Department and their rates shall be without references to any<br />
local custom.<br />
9. Under no circumstances shall any contractor be entitled to claim enhanced rates for any item<br />
in this contract.<br />
10. All corrections and additions or pasted slips should be initialed.<br />
11. The measurements of work shall be taken according to the usual methods in use in the Public<br />
Works Department and no proposals to adopt alternative methods shall be accepted. The<br />
Executive Engineer’s decision as to what is “the usual method in use in the Public Works<br />
Department” shall be final.<br />
12. The tendering Contractor shall furnish a declaration alongwith the tender showing all works<br />
for which he has already entered into contract and the value of the work that remains to be<br />
executed in each case on the date of submitting the tender.<br />
13. <strong>No</strong> foreign exchange would be released by the Department for the purchase of plant and<br />
machinery required for the execution of the work contracted for.<br />

14. The contractor shall have to construct shed for storing controlled and valuable materials<br />
brought by the contractor at work site having double locking arrangement at contractor’s cost.<br />
The materials shall then be taken for use in the presence of the Departmental person. <strong>No</strong><br />
material shall be allowed to be removed from the site of works.<br />
15. The contractors shall also give a list of machinery in their possession, which they propose to<br />
use on the work.<br />
16. Successful tenderer shall have to produce to the satisfaction of the accepting authority a valid<br />
and current license issued in his favour under the provisions of Contract Labour (Regulation<br />
and Abolition) Act, 1973 before starting the work. Failing which, acceptance of the tender<br />
shall be liable for withdrawal and earnest money shall be forfeited to the Government (refere<br />

17. The contractor shall comply with the provisions of Apprentices Act,1961 and the rules and<br />
orders issued thereunder from time to time. If he fails to do so, his failure shall be breach of<br />
the contract and the Chief Engineer Superintending Engineer, may in his discretion cancel the<br />
contract. The contractor shall also be liable for any pecuniary liability arising on account of<br />
any violation by him of the provisions of the said Act.<br />
