69 Dy. Executive Engineer<br />

20. ANCILLARY WORK :<br />

The Contractor shall submit to Engineer-in-charge in writing the details of all ancillary works<br />

including layout and specifications to be followed for its construction. Ancillary work shall not<br />

be taken up in hand unless approved by Engineer-in-charge. The Engineer-in-charge<br />

reserves the right to suggest modifications or make complete changes in the layout and<br />

specifications proposed by the Contractor at any stage to ensure the safety on the work site.<br />

The Contractor shall carry out all such modifications to the ancillary works at his own<br />

expenses as ordered by Engineer-in-charge.<br />

21 SPECIAL CONDITIONS:<br />

21.1 The Contractor should ensure that all safety precautions are observed by their laboures,<br />

working closed to the State Highway and while closing the State Highway precautions are<br />

taken including insurance etc., for their labour at the cost of the contractor and the contractor<br />

will bear all the expenses, compensation etc. if any accident occurs to the labour etc. <strong>No</strong><br />

claim in this regard on whatsoever account shall be entertained and this decision of the<br />

Department will be final and conclusive.<br />

21.2 The Contractor shall observe the rules and regulation imposed by traffic police for smooth<br />

flow of traffic on the diversion road and shall not be entitled for claims any compensation<br />

arising thereof.<br />

21.3 In case of delay in handing over the land required for the work, due to unforeseen cause, the<br />

Contractor shall not be entitled for any compensation what-so-ever form the Government on<br />

ground that the machinery or labour was idle for certain period. Contractor may, however<br />

apply for extension of time limit which may be granted on the merit of the case.<br />

22. REJECTION OF MATERIALS NOT CONFORMING TO SPECIFICATIONS:<br />

Any stock or batch of material(s) of which sample(s) does not conform to the prescribed test<br />

and quality, shall be rejected by the Engineer or his representative and such materials shall<br />

be removed from site by the Contractor at his own cost. Such rejected materials shall not be<br />

made acceptable by any modifications. Materials not corresponding in character and Quality<br />

with approved samples will be rejected by the Engineer or his representative and shall be<br />

removed from site at the Contractor’s own cost.<br />

23. INSPECTION OF OPERATIONS:<br />

The Engineer and any person authorised by him shall at all times have access to the works<br />

and to all workshops and places (including required documents) where work is being<br />

prepared or from where materials, manufactured articles or machinery are being obtained for<br />

the works and the Contractor shall afford every facility for & every assistance in or in obtaining<br />

the right to such access.<br />

24. FIELD LABORATORY:<br />

The Contractor shall arrange to provide a well-furnished and fully equipped field laboratory<br />

which shall be manned by adequately qualified technical staff. The laboratory shall preferably<br />

be located adjacent to the plant site and shall be provided with amenities like water supply,<br />

electric supply, toilet block etc. The list of equipment is enclosed on Page <strong>No</strong>.80. This shall<br />

be considered as incidental to work and no separate payment whatsoever will be made for<br />

the same.<br />

25. SUPPLY OF COLOURED RECORD PHOTOGRAPHS AND ALBUMS:<br />

The Contractor shall arrange to take dated post card size coloured photographs at various<br />

stages/facts of the work including interesting and novel features of the work as desired by the<br />

Engineer-in-charge and supply them in five copies each in separate albums of appropriate<br />

size. He shall also arrange for the Video Filming of important activities of the work during the<br />

currency of the contract and edit it to a video film of 60 to 180 minutes playing time. It shall<br />

contain narration of the various activities in English/Marathi by a competent narrator. The<br />

cassette shall be of acceptable quality and the film shall be capable of producing color<br />

pictures. This shall be considered as incidental to the work and no additional payment<br />

whatsoever will be made for the same.<br />

26. SUPPLY OF SAFETY JACKETS TO LABOURERS/SUPERVISORS/ENGINEERS<br />

As a safety measure during the execution of work all labours, construction and supervisory<br />

staff shall be provided with an orange colour jacket in fluorescent blue so as to make them<br />

starkly visible from a distance even during evening hours.<br />
