money for this work arise due to failure on my/our part to (i) abide by the
stipulations to keep the offer open for the period mentioned above or (ii)
sign and complete the contract documents and furnish the security
deposit as specified in item (d) of the Memorandum contained in
paragraph (1) above within the time limit laid down in clause (1) of the
annexed General Conditions of Contract, the amount payable by me/us
may, at the option of the Engineer, be recovered out of the amount
deposited in lump sum for securing exemption in so far as the same may
extend in terms of the said bond and in the event of the deficiency out of
any other payments which are due or payable to me/us by the
Government under any other contract or transaction of any nature
whatsoever or otherwise.
4. Should this tender be accepted I/We hereby agree to abide by and
fulfill all the terms, and provisions of the conditions of contract annexed
hereto so far as applicable, and in default thereof to forfeit and pay to
Government the sums of money mentioned in the said conditions.
