11. TESTING ETC.:<br />

The Contractor shall be responsible for the quality of the work in the entire construction work<br />

within the contract. He shall, therefore, have his own independent and adequate setup for<br />

ensuring the same. This shall include establishing field laboratory for testing required for<br />

concrete works.<br />

12. AUTHORITIES OF THE ENGINEER IN CHARGE:<br />

Save in so far as it is legally or physically impossible the Contractor shall execute, complete<br />

and maintain the works in strict accordance with the contract under the directions and to the<br />

entire satisfaction of the Engineer in charge and shall comply with and adhere strictly to the<br />

Engineer-in-charge’s instructions and directions on any matter (Whether mentioned in the<br />

contract or not) pertaining to this works.<br />

The Engineer in charge shall decide all questions which may arise as to quality and<br />

acceptability of materials furnished and work executed, manner of execution, rate of progress<br />

of the works, interpretation of the plans and specifications and acceptability of fulfillment of<br />

the contract on the part of the Contractor . He shall determine the amount and quantity of<br />

work performed and materials furnished and his decision shall be final. In all such matters,<br />

and in any technical questions which may arise touching the contract, his decision shall be<br />

binding on the Contractor.<br />

The Engineer in charge shall have the power to enforce such decisions and orders if the<br />

Contractor fails to carry them out promptly. If the Contractor fails to execute the work ordered<br />

by the Engineer-in-charge . The Engineer in charge may give notice to Contractor specifying<br />

a reasonable period therein and on the expiry of that period proceed to execute such work as<br />

may be deemed necessary and recover the cost there of from the Contractor.<br />

12.1 AUTHORITIES OF THE ENGINEER-IN-CHARGE'S REPRESENTATIVE<br />

The duties of the representative of the Engineer-in-charge are to watch and supervise the<br />

work and to test and examine any material to be used for workmanship employed in<br />

connection with the works.<br />

12.2 The Engineer-in-charge may from time to time, in writing delegate to his representative any of<br />

the powers and authorities vested in the Engineer-in-charge and shall furnish to the<br />

Contractor a copy of all such delegations of powers and authorities. Any written instruction or<br />

approval given by the representative of the Engineer-in-charge to the Contractor within the<br />

terms of such delegations (but not otherwise) shall bind the Contractor and the Department as<br />

though it had been given by the Engineer-in-charge, provided always as follows.<br />

a) Failure of the representative of the Engineer-in-charge to disapprove any work or<br />

material shall not prejudice the power of the Engineer-in-charge there after to<br />

disapprove such work or materials and to order to pulling down, removal or breaking<br />

up thereof.<br />

b) If the Contractor is dissatisfied with any decision of the Representative of the<br />

Engineer-in-charge he shall be entitle to refer the matter to the Engineer-in-charge,<br />

who shall there upon confirm/reverse or vary such decision.<br />

13. LAY OUT OF WORK:<br />

Layout of the work will be done by the Contractor in consultation with the Executive Engineer<br />

of the Department or his representative, some permanent marks should however be<br />

established to indicate the demarcation of the structure or any component there of made to<br />

this permanent marks in measurement books and drawing signed by the contractor and the<br />

departmental officer, Responsibility regarding layout will be joint.<br />

14. SETTING OUT<br />

14.1 BUILDING WORKS :-<br />

The Engineer-in-charge shall furnish the contractor with only the four corners of the works site<br />

and a level bench mark and the contractor shall set out the works and shall provide an<br />

efficient staff for the purpose and shall be solely responsible for the accuracy of such setting<br />

out.<br />
