3.5Q: What level <strong>of</strong> <strong>in</strong>dividualized attention must be provided to a child <strong>with</strong><br />

epilepsy?<br />

A: A child care provider is generally not required to hire additional staff or provide<br />

its own constant one-to-one supervision <strong>of</strong> a child <strong>in</strong> a group child care situation.<br />

However, most children need <strong>in</strong>dividualized attention at times. If a child who<br />

needs some <strong>in</strong>dividual attention can be <strong>in</strong>cluded successfully <strong>in</strong>to a child care<br />

program <strong>with</strong>out fundamentally alter<strong>in</strong>g the program, the child cannot be<br />

excluded from the program just because he or she needs some one-to-one<br />

attention.<br />

<strong>Child</strong> care centers have been required to provide some level <strong>of</strong> temporary<br />

<strong>in</strong>dividualized attention to a child <strong>with</strong> a disability as long as provid<strong>in</strong>g such<br />

care does not fundamentally alter the nature <strong>of</strong> the program. 19 Such<br />

<strong>in</strong>dividualized attention can <strong>in</strong>clude, for example, adm<strong>in</strong>ister<strong>in</strong>g diabetes<br />

medication and monitor<strong>in</strong>g for signs <strong>of</strong> hypoglycemic shock, 20 operat<strong>in</strong>g a<br />

blood-glucose meter and <strong>in</strong>sul<strong>in</strong> pump 21 and monitor<strong>in</strong>g wheez<strong>in</strong>g. 22 Required<br />

<strong>in</strong>dividual care may also <strong>in</strong>volve provid<strong>in</strong>g a disability-related service such as<br />

chang<strong>in</strong>g diapers and remov<strong>in</strong>g leg braces, if such services can be provided at<br />

m<strong>in</strong>imal expense and <strong>with</strong> basic, non-medical tra<strong>in</strong><strong>in</strong>g. 23<br />

However, courts and enforcement agencies have been reluctant to require day<br />

care centers to adm<strong>in</strong>ister some medications, such as <strong>in</strong>sul<strong>in</strong>, when use <strong>of</strong><br />

medications and care. In particular, the Department <strong>of</strong> Justice has actively enforced this requirement<br />

through litigation and settlements. See, e.g., Settlement Agreement under the ADA between the United<br />

compla<strong>in</strong>t filed by the Department <strong>of</strong> Justice <strong>in</strong> this case alleged that La Petite Academy discrim<strong>in</strong>ated<br />

aga<strong>in</strong>st children <strong>with</strong> severe allergies by ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g a policy <strong>of</strong> refus<strong>in</strong>g to adm<strong>in</strong>ister ep<strong>in</strong>ephr<strong>in</strong>e through<br />

the EpiPen (a disposable device used to adm<strong>in</strong>ister a premeasured dose <strong>of</strong> ep<strong>in</strong>ephr<strong>in</strong>e to people<br />

experienc<strong>in</strong>g anaphylaxis). The agreement called for, among other th<strong>in</strong>gs, a total payment by La Petite <strong>of</strong><br />

$55,000 to three <strong>in</strong>dividual compla<strong>in</strong>ants. A similar settlement was reached by the Department <strong>of</strong> Justice <strong>in</strong><br />

a case <strong>in</strong>volv<strong>in</strong>g “f<strong>in</strong>ger prick” blood glucose monitor<strong>in</strong>g for children <strong>with</strong> diabetes. See Settlement <strong>in</strong><br />
