physician would probably be the one who would be prescrib<strong>in</strong>g any health<br />

services the nurse would need to provide dur<strong>in</strong>g the school day, the physician’s<br />

op<strong>in</strong>ion about the need for a one-to-one aide, an educational position, might<br />

carry much less weight precisely because the physician would be render<strong>in</strong>g a<br />

medical, rather than an educational, op<strong>in</strong>ion about the student’s needs. In this<br />

case, the parents might want to turn to an educational expert who could observe<br />

their child across school sett<strong>in</strong>gs—<strong>in</strong> class, the cafeteria, the playground—and<br />

make a recommendation about the level <strong>of</strong> staff<strong>in</strong>g that would enable the student<br />

to be served <strong>in</strong> a way that facilitates the student’s safe participation <strong>in</strong> school<br />

activities and allows him or her to make mean<strong>in</strong>gful educational progress.<br />

4.21Q: If a child <strong>with</strong> epilepsy needs a one-to-one aide or nurse, is the parent<br />

entitled to choose the provider or staff person who will be assigned to the<br />

child?<br />

A: No. Parents do not have the right to choose the staff who will be assigned to<br />

work <strong>with</strong> their child. However, if a school team and a student’s parents have a<br />

good work<strong>in</strong>g relationship, they may be able to agree that it is educationally<br />

appropriate for the parents to have some <strong>in</strong>volvement <strong>in</strong> the process, or at least<br />

to meet the person who is identified and to be part <strong>of</strong> the tra<strong>in</strong><strong>in</strong>g process.<br />

4.22Q: Can tra<strong>in</strong><strong>in</strong>g <strong>of</strong> the aide or nurse be <strong>in</strong>cluded on the IEP?<br />

A: Yes. Tra<strong>in</strong><strong>in</strong>g can and should be <strong>in</strong>cluded on the IEP. The type and amount <strong>of</strong><br />

tra<strong>in</strong><strong>in</strong>g the provider will need should be specified on the IEP, along <strong>with</strong> who<br />

will provide the tra<strong>in</strong><strong>in</strong>g. Tra<strong>in</strong><strong>in</strong>g should be viewed as a support service for staff<br />

<strong>in</strong> accord <strong>with</strong> 34 C.F.R. 300.324(a)(3)(ii), which requires that the IEP team<br />

make a determ<strong>in</strong>ation <strong>of</strong> “[s]upplementary aids and services, program<br />

modifications and support for school personnel” that will enable a student to<br />

participate <strong>in</strong> the general education curriculum and participate <strong>in</strong> extracurricular<br />

and nonacademic activities.<br />

4.23Q: Who participates <strong>in</strong> the development <strong>of</strong> the IEP?<br />

A: The IEP team must <strong>in</strong>clude the student’s parents, at least one general education<br />

teacher if the student participates or may participate <strong>in</strong> general education, at least<br />

one special education teacher, a representative <strong>of</strong> the school district who is<br />

qualified to provide or supervise special education and is knowledgeable about<br />

the general education curriculum and the district’s resources, a person who can<br />

<strong>in</strong>terpret the <strong>in</strong>structional implications <strong>of</strong> evaluation results, the student<br />

whenever appropriate, and, at the discretion <strong>of</strong> the parents or district, other<br />

<strong>in</strong>dividuals who have knowledge or special expertise regard<strong>in</strong>g the student. 34<br />
