they would like to propose. On occasion, drafts can be exchanged prior to the<br />
meet<strong>in</strong>g; when this is able to occur, the meet<strong>in</strong>g will tend to be more efficient.<br />
If the district has sent a meet<strong>in</strong>g notice that does not <strong>in</strong>clude all <strong>of</strong> the items that<br />
the parents would like to discuss, the attorney or advocate can send a letter<br />
request<strong>in</strong>g that the additional items be added to the agenda. The attorney can ask<br />
that additional time be allotted for the meet<strong>in</strong>g or that the team be prepared to<br />
cont<strong>in</strong>ue the meet<strong>in</strong>g to another day as it may not f<strong>in</strong>ish on the scheduled day.<br />
Additionally, the attorney or advocate should be sure to provide written notice<br />
or have the parents provide notice that the attorney or advocate will be <strong>in</strong><br />
attendance; many, but not all, districts send their own lawyer to IEP meet<strong>in</strong>gs if<br />
the parents br<strong>in</strong>g an attorney or even, sometimes, an advocate.<br />
4.26Q: What happens if a parent disagrees <strong>with</strong> an <strong>in</strong>itial or subsequent IEP?<br />
A: The parent can file an IDEA compla<strong>in</strong>t <strong>with</strong> the state department <strong>of</strong> education or<br />
can ask for mediation or a due process hear<strong>in</strong>g. Generally, mediation or a due<br />
process hear<strong>in</strong>g request will be more effective <strong>in</strong> resolv<strong>in</strong>g an IEP dispute than a<br />
compla<strong>in</strong>t if the issue is the appropriateness <strong>of</strong> the IEP, as state departments <strong>of</strong><br />
education will usually not second-guess the substantive decision <strong>of</strong> an IEP team.<br />

4.27Q: Is there a timel<strong>in</strong>e for IEP implementation?<br />
A: No, federal law simply requires that special education and related services be<br />
provided <strong>in</strong> accord <strong>with</strong> an IEP as soon as possible after the development <strong>of</strong> the<br />
<strong>in</strong>itial IEP and that, at the beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> each school year, each child <strong>with</strong> a<br />
disability must have an IEP <strong>in</strong> effect. 34 C.F.R. 300.323. The federal timel<strong>in</strong>es<br />
for the special education process are set out at the end <strong>of</strong> this chapter. However,<br />
states may have their own regulations that set specific IEP implementation<br />
timel<strong>in</strong>es.<br />
4.28Q: Where do students <strong>with</strong> epilepsy or other disabilities receive special<br />
education services?<br />
A: The IDEA requires a cont<strong>in</strong>uum <strong>of</strong> placement options for students <strong>with</strong><br />
disabilities. Depend<strong>in</strong>g on their needs, students <strong>with</strong> epilepsy may receive<br />
special education <strong>in</strong> the general education classroom, a separate classroom, a<br />
separate school, a residential school, at home or <strong>in</strong> the hospital, or <strong>in</strong> some<br />
comb<strong>in</strong>ation <strong>of</strong> placements. The cont<strong>in</strong>uum ranges from least restrictive to most<br />
