DOING BUSINESS INTHE DOMINICAN REPUBLIC98Zero Rate for ExportersA zero rate shall be assessed on any goods designed for exportation. Exportersshall be entitled to a deduction of <strong>the</strong> value of such tax as would have beenassessed on <strong>the</strong> purchase of any goods designed for exportation. If any balancerema<strong>in</strong>ed <strong>in</strong> favor of exporter, such a balance shall be reimbursed to <strong>the</strong> InternalRevenue Office. The same shall apply to any Selective Consumer Tax paid byexporters, provided both ITBIS and Selective Consumer credits were reflected bysaid exporters <strong>in</strong> a recurrent manner dur<strong>in</strong>g 6 months or more. To this end, anapplication for reimbursement or compensation shall be addressed to <strong>the</strong> InternalRevenue Office which shall have a term of two month to reply; if no reply werereceived dur<strong>in</strong>g such term, exporter shall be authorized to have any such balanceoffset aga<strong>in</strong>st any o<strong>the</strong>r tax except any tax reta<strong>in</strong>ed to a third party. It may evenbe offset aga<strong>in</strong>st a tax reta<strong>in</strong>ed on <strong>the</strong> occasion of any dividends paid <strong>in</strong> cash.Retentions at <strong>the</strong> Source. Payments Abroad <strong>in</strong> General.Thirty percent (30%) of any assessable <strong>in</strong>come from a Dom<strong>in</strong>ican source thatwere paid or credited to account to any <strong>in</strong>dividuals that were not resid<strong>in</strong>g orwere not <strong>do</strong>miciled <strong>in</strong> <strong>the</strong> Dom<strong>in</strong>ican <strong>Republic</strong>, o<strong>the</strong>r than <strong>in</strong>terest paid or creditedto account to f<strong>in</strong>ancial agencies abroad or any dividends <strong>the</strong>reon, shall bereta<strong>in</strong>ed and given entry by <strong>the</strong> Tax Adm<strong>in</strong>istration as sole and f<strong>in</strong>al tax payment.Such a rate shall be gradually reduced <strong>do</strong>wn to 25% aga<strong>in</strong> <strong>in</strong> 2009.Interest Paid or Credited AbroadTen percent (10%) of any <strong>in</strong>terest from a Dom<strong>in</strong>ican Source that were paid orcredited on account of loans secured with credit agencies abroad shall bereta<strong>in</strong>ed and given entry by <strong>the</strong> Tax Adm<strong>in</strong>istration as sole and f<strong>in</strong>al tax payment.Designation of Retention AgentCorporations and sole owner enterprises shall act as retention agents wheneverpay<strong>in</strong>g or credit<strong>in</strong>g to account any considerations to o<strong>the</strong>r <strong>in</strong>dividuals or nondivided estates, as well as to o<strong>the</strong>r non tax exempted entities, except corporations.Such retentions as are provided here<strong>in</strong> shall be for <strong>the</strong> follow<strong>in</strong>g percentagesof gross <strong>in</strong>come:a) 10% of any amounts paid or credited to account for any rental or lease of anyk<strong>in</strong>d of real or personal property, as payment on account;b) 10% of any fees, commissions and o<strong>the</strong>r remunerations or payments for <strong>the</strong>render<strong>in</strong>g of services <strong>in</strong> general by <strong>in</strong>dividuals o<strong>the</strong>r than under a relatioship of dependency <strong>the</strong> provision whereof required <strong>the</strong> direct <strong>in</strong>terventionof a human resource, as payment on account;c) 15% of any prizes or ga<strong>in</strong>s from any lottery, “fracatán”, lotto, lotto quiz,electronic games, b<strong>in</strong>gos, horse races, bett<strong>in</strong>g banks, cas<strong>in</strong>os and any o<strong>the</strong>rk<strong>in</strong>d of prize offered through promotion or advertis<strong>in</strong>g campaigns, as f<strong>in</strong>alpayment.d) 5% of any payments effected by <strong>the</strong> State or any of its agencies, <strong>the</strong>re<strong>in</strong><strong>in</strong>clud<strong>in</strong>g state enterprises and decentralized and autonomous bodies,
