Law 126-02 applies to any type of <strong>in</strong>formation conta<strong>in</strong>ed<strong>in</strong> a digital <strong>do</strong>cument or data message, apart from obligations of <strong>the</strong> Dom<strong>in</strong>icanState under <strong>in</strong>ternational treaties or conventions and <strong>the</strong> announcements that byvirtue of law must be pr<strong>in</strong>ted <strong>in</strong> certa<strong>in</strong> products because of <strong>the</strong> risk result<strong>in</strong>gfrom <strong>the</strong>ir commercialisation, use or consumption.b) Def<strong>in</strong>itionsElectronic commerce. Any <strong>bus<strong>in</strong>ess</strong> relation, whe<strong>the</strong>r contractual or not, buildupon <strong>the</strong> use of one or more digital <strong>do</strong>cuments, data messages or any similarmedium. Bus<strong>in</strong>ess relations <strong>in</strong>clude, without limitation, <strong>the</strong> follow<strong>in</strong>g operations:supply or exchange of goods, services or <strong>in</strong>formation, distribution or representationagreements, factor<strong>in</strong>g, lease or rent contracts, construction of works, consult<strong>in</strong>g,eng<strong>in</strong>eer<strong>in</strong>g, license agreements, <strong>in</strong>vestment, f<strong>in</strong>anc<strong>in</strong>g, bank<strong>in</strong>g, <strong>in</strong>surance,exploitation of public services, jo<strong>in</strong>t ventures and o<strong>the</strong>r forms of <strong>in</strong>dustrialor commercial co-operation, and transport of passengers.Data messages. The <strong>in</strong>formation created, sent, received, stored or communicatedby electronic, optical or similar means, such as electronic data exchange, electronicmail, telegram, telex or fax.Electronic data exchange. Electronic transmission from one computer to ano<strong>the</strong>r,when <strong>the</strong> <strong>in</strong>formation is organised accord<strong>in</strong>g to agreed technical rules.Digital signature. Numeric value attached to a data message that, us<strong>in</strong>g a knownma<strong>the</strong>matical procedure l<strong>in</strong>ked to <strong>the</strong> key of <strong>the</strong> sender and <strong>the</strong> message text,allows to establish that such value has been obta<strong>in</strong>ed exclusively with <strong>the</strong> key of<strong>the</strong> sender and <strong>the</strong> message text,and that <strong>the</strong> <strong>in</strong>itial message has not been amendedafter <strong>the</strong> transmission has been made.Electronic signature. Group of electronic <strong>in</strong>tegrated data,logically l<strong>in</strong>ked or associatedto o<strong>the</strong>r electronic data used by mutual agreement as means of identificationbetween <strong>the</strong> sender and receiver of a data message or digital <strong>do</strong>cument andthat lacks some of <strong>the</strong> legal requirements provided for digital signatures.Legal Recognition. Law 126-02 grants legal recognition to digital <strong>do</strong>cumentsand data messages, provid<strong>in</strong>g that <strong>the</strong>re shall not be denied legal effects, validityor force to any type of <strong>in</strong>formation solely on <strong>the</strong> grounds that it is <strong>in</strong> <strong>the</strong>form of a digital <strong>do</strong>cument or data message. Fur<strong>the</strong>rmore, any legal requirementsof written proof, signature of <strong>do</strong>cuments and preservation of orig<strong>in</strong>alsshall be deemed to be fulfilled when <strong>the</strong> requirements provided <strong>in</strong> <strong>the</strong> law forsuch purposes <strong>in</strong> respect of digital <strong>do</strong>cuments and signatures have been compliedwith. In addition, electronic means may be used for <strong>the</strong> execution of contractsand as evidence <strong>in</strong> legal proceed<strong>in</strong>gs, hav<strong>in</strong>g <strong>the</strong> same force as privateagreements.As to digital signature, it is established that it will have <strong>the</strong> same legal force and121
