The <strong>in</strong>stitutions en<strong>do</strong>wed with <strong>the</strong> attribution of monitor<strong>in</strong>g <strong>the</strong>sector and see<strong>in</strong>g to <strong>the</strong> compliance of Law 125-01 are <strong>the</strong> National EnergyCommission, <strong>the</strong> policy-mak<strong>in</strong>g organ, and <strong>the</strong> Super<strong>in</strong>tendence of Electricity,whose ma<strong>in</strong> function is to see to <strong>the</strong> compliance of <strong>the</strong> respective laws and regulations.The law sets forth <strong>the</strong> necessary guarantees of <strong>in</strong>dependence and qualificationsof <strong>the</strong>ir members <strong>in</strong> order to ensure <strong>the</strong> proper function<strong>in</strong>g of <strong>the</strong>se agencies.Fur<strong>the</strong>rmore, Law 125-01 provided for <strong>the</strong> transformation of CorporaciónDom<strong>in</strong>icana de Electricidad (CDE) <strong>in</strong>to three different entities that will carry out<strong>the</strong> Government activities <strong>in</strong> <strong>the</strong> energy sector:Empresa de Transmisión Eléctrica Dom<strong>in</strong>icana (ETED), or Dom<strong>in</strong>icanElectricity Transmission company, to which all electricity l<strong>in</strong>es and transmissionsystems shall be transferred.Empresa de Generación Hidroeléctrica Dom<strong>in</strong>icana (EGEHID), or Dom<strong>in</strong>icanHydroelectric Generation Company, to which all property and managementof hydroelectric generat<strong>in</strong>g systems will be transferred.Corporación Dom<strong>in</strong>icana de Empresas Eléctricas Estatales (CDEEE), orDom<strong>in</strong>ican Corporation of State Electricity Companies, with <strong>the</strong> mission ofco-coord<strong>in</strong>at<strong>in</strong>g <strong>the</strong> activities of such companies, implement<strong>in</strong>g publicprograms of rural electrification and manag<strong>in</strong>g energy supply contracts withprivate producers.71c) Provision of Electricity Services. The generation and distribution of electricityrequires <strong>the</strong> grant<strong>in</strong>g of a concession. However, where <strong>the</strong> maximum powerdemand is <strong>in</strong>ferior to <strong>the</strong> levels established <strong>in</strong> <strong>the</strong> regulations, only a permit isrequired.Law 125-01 provides for provisional and def<strong>in</strong>itive concessions. Def<strong>in</strong>itive concessionsmust be granted by <strong>the</strong> Executive Branch via <strong>the</strong> National EnergyCommission, and are valid for a renewable period of forty years. In <strong>the</strong> event ofplurality of requests <strong>in</strong> relation to <strong>the</strong> same concession, <strong>the</strong> respective concessionshall be granted by public bidd<strong>in</strong>g.The law <strong>in</strong>cludes also provisions def<strong>in</strong><strong>in</strong>g <strong>the</strong> obligation of <strong>in</strong>terconnection.Theuse of transmission l<strong>in</strong>es is subject to <strong>the</strong> payment of a transmission toll that is
