<strong>Pellerano</strong> & <strong>Herrera</strong>Attorneys at law111a) PatentsPatents may be obta<strong>in</strong>ed to protect <strong>in</strong>ventions, utility models and <strong>in</strong>dustrialdesigns.Inventions are def<strong>in</strong>ed as any idea or creation of <strong>the</strong> human <strong>in</strong>tellect, whe<strong>the</strong>rrelated to products or processes, capable of be<strong>in</strong>g applied to <strong>in</strong>dustry. Notpatentable subject matter <strong>in</strong>cludes:1. Discoveries already exist<strong>in</strong>g <strong>in</strong> nature, scientific <strong>the</strong>ories and ma<strong>the</strong>maticmethods,2. Solely aes<strong>the</strong>tic creations,3. Presentations of <strong>in</strong>formation,4. Computer programs,5. Therapeutic,chirurgical or diagnostic methods for human or animal treatment,6. Liv<strong>in</strong>g matter and substances already exist<strong>in</strong>g <strong>in</strong> nature, and7. New uses of patented products or processes.Fur<strong>the</strong>rmore, <strong>in</strong>ventions whose exploitation goes aga<strong>in</strong>st public order or moral,or which may be clearly prejudicial to health,human life or <strong>the</strong> environment,maynot be patented or published.The same goes for plants and animals, as well as foressentially biological processes for <strong>the</strong> production <strong>the</strong>reof. In this regard, onlynon-biological or microbiologic process may be patented, while vegetable <strong>in</strong>ventionswill be regulated by special legislation.Inventions must be of practical <strong>in</strong>dustrial use: capable of be<strong>in</strong>g produced or used<strong>in</strong> any of <strong>the</strong> types of <strong>in</strong>dustry, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> service <strong>in</strong>dustry.They must also be novel: be unknown <strong>in</strong> <strong>the</strong> body of exist<strong>in</strong>g technical knowledge,whichcomprises anyth<strong>in</strong>g that has been published or made available to <strong>the</strong>public anywhere <strong>in</strong> <strong>the</strong> world, whe<strong>the</strong>r by written publication, oral disclosure,commercialisation, use, or any o<strong>the</strong>r method, before <strong>the</strong> date of <strong>the</strong> local or(when applicable) foreign patent application.Disclosure made with<strong>in</strong> one year prior to <strong>the</strong> patent application is not taken <strong>in</strong>toaccount, provided it has been made directly or <strong>in</strong>directly by <strong>the</strong> <strong>in</strong>ventor orhis/her representatives, or resulted from breach of trust or contract, or illegalacts, committed aga<strong>in</strong>st <strong>the</strong>m.Fur<strong>the</strong>rmore, <strong>in</strong>ventions must show an <strong>in</strong>ventive step: <strong>the</strong>y must not be capableof be<strong>in</strong>g deducted,by a person with knowledge <strong>in</strong> <strong>the</strong> technical field,or from <strong>the</strong>respective body of exist<strong>in</strong>g technical knowledge.Patent applications may be filed with <strong>the</strong> National Office of Industrial Property,and must conta<strong>in</strong> <strong>the</strong> follow<strong>in</strong>g elements:Identification of <strong>the</strong> <strong>in</strong>ventor, applicant (if different) and legal representatives;Proof of title over <strong>the</strong> <strong>in</strong>vention;Name,description,one or more claims,draw<strong>in</strong>gs and summary of <strong>the</strong> <strong>in</strong>vention;andPayment of respective fees.Applications have priority over later applications regard<strong>in</strong>g <strong>the</strong> same <strong>in</strong>vention.The date of application is that of fil<strong>in</strong>g when <strong>the</strong> filed application complies with
