<strong>Pellerano</strong> & <strong>Herrera</strong>Attorneys at lawValley.This m<strong>in</strong>e's reserves are considered to be “first class”, with an estimatedcapacity of 403,000 ounces of gold, 2.2 million ounces of silver and 90 millionpounds of z<strong>in</strong>c per year for at least 30 years.However, due to a considerable drop <strong>in</strong> production and <strong>the</strong> low gold prices at <strong>the</strong><strong>in</strong>ternational markets,<strong>the</strong> public enterprise did not have <strong>the</strong> resources required toexploit <strong>the</strong>m properly.Therefore, an <strong>in</strong>ternational bidd<strong>in</strong>g process was carried out<strong>in</strong> order to choose an <strong>in</strong>ternational m<strong>in</strong><strong>in</strong>g company that would act as long-termoperator of Pueblo Viejo.The procedure ended with <strong>the</strong> selection on June 2001 ofa Canadian capital company, which committed itself to <strong>in</strong>vest US$336 million, andto start operations with<strong>in</strong> 36 months after <strong>the</strong> execution of <strong>the</strong> leas<strong>in</strong>g agreementwith <strong>the</strong> authorities that will have a 25-years duration.F<strong>in</strong>ally, we should note that <strong>in</strong> November 2004, after ten years, <strong>the</strong> Program SYS-MIN I came to an end, which produced a wide-rang<strong>in</strong>g study that can serve as aplatform for <strong>the</strong> geological and m<strong>in</strong><strong>in</strong>g development of <strong>the</strong> Dom<strong>in</strong>ican <strong>Republic</strong>.Its general benefits are <strong>the</strong> follow<strong>in</strong>g:1. The negative evolution that <strong>the</strong> sector had at <strong>the</strong> end of <strong>the</strong> 80's and dur<strong>in</strong>g<strong>the</strong> 90's has been reverted by promot<strong>in</strong>g and widen<strong>in</strong>g <strong>the</strong> knowledge of <strong>the</strong>country's subsoil and of m<strong>in</strong>eral resources <strong>in</strong> particular, <strong>the</strong> exploitation ofcerta<strong>in</strong> rocks and <strong>in</strong>dustrial m<strong>in</strong>erals, and <strong>the</strong> control of environmentalimpact. In this way private <strong>in</strong>vestment has been attracted to this sector, thuscontribut<strong>in</strong>g to <strong>the</strong> vertical and horizontal diversification of <strong>the</strong> nationaleconomy.2. Contribut<strong>in</strong>g to <strong>the</strong> knowledge of <strong>the</strong> country's subsoil and of m<strong>in</strong>eral andwater resources <strong>in</strong> particular, as well as seismic activities. It has also helpedto make better use of certa<strong>in</strong> <strong>in</strong>dustrial m<strong>in</strong>erals by rationaliz<strong>in</strong>g productionand <strong>the</strong> control of environmental impact.67OBTAINING MINING CONCESSIONSLaw 146 of 1971 regulates m<strong>in</strong><strong>in</strong>g activities.The entity charged of supervis<strong>in</strong>g <strong>the</strong>sector is <strong>the</strong> General M<strong>in</strong><strong>in</strong>g Office of <strong>the</strong> M<strong>in</strong>istry of Industry and Trade(“Secretaría de Esta<strong>do</strong> de Industria y Comercio-SEIC”).Law 146 allows any national or foreign person or company to register <strong>the</strong> discoveryof m<strong>in</strong>eral deposits and request a concession <strong>in</strong> order to explore orexploit such deposits.The exploration concession grants its holder <strong>the</strong> right to carry out activitiesabove or below <strong>the</strong> earth surface <strong>in</strong> order to def<strong>in</strong>e <strong>the</strong> areas conta<strong>in</strong><strong>in</strong>g m<strong>in</strong>eraldeposits by us<strong>in</strong>g any technical and scientific methods. For such purposes hemay construct build<strong>in</strong>gs, <strong>in</strong>stall mach<strong>in</strong>ery, communication l<strong>in</strong>es and any o<strong>the</strong>requipment that his researches require.The exploitation concession may be requested at any time dur<strong>in</strong>g <strong>the</strong> explorationstage, and grants <strong>the</strong> right to prepare and extract all m<strong>in</strong>eral substances found <strong>in</strong><strong>the</strong> area, allow<strong>in</strong>g <strong>the</strong> beneficiary to exploit, melt and use for any <strong>bus<strong>in</strong>ess</strong> purpose<strong>the</strong> extracted materials.This concession is granted for a period of 75 years.
