DOING BUSINESS INTHE DOMINICAN REPUBLICTo plan, guide, co-ord<strong>in</strong>ate, promote and evaluate tourist activities.To program and promote <strong>the</strong> tourist <strong>in</strong>dustry and <strong>the</strong> <strong>in</strong>vestments <strong>in</strong> <strong>the</strong> sector.To establish and supervise tourist zones.To guide <strong>the</strong> design and construction of <strong>in</strong>frastructure.To carry out promotional campaigns.To control tourist operators.To create national and <strong>in</strong>ternational offices.The M<strong>in</strong>istry of Tourism has offices for tourist promotion <strong>in</strong> <strong>the</strong> United States,Spa<strong>in</strong>, France, Germany, England, Belgium, Italy, Canada, Puerto Rico, Venezuela,Argent<strong>in</strong>a, Chile and Colombia. These offices carry out activities such as <strong>in</strong>formationservices, advertisement through <strong>the</strong> media, organization of traditional festivitiesand participation <strong>in</strong> <strong>in</strong>ternational fairs.REGULATION OF TOURIST ACTIVITIESLaw 541-69General Requirements. Tourism Organic Law No. 541 of 31 December 1969 providesthat any persons or companies that offer ma<strong>in</strong>ly tourist services and thatare considered to be a part of <strong>the</strong> national tourism organization, shall be registeredwith <strong>the</strong> M<strong>in</strong>istry of Tourism, be<strong>in</strong>g subject to its supervision.Hotels. Rule 2115 on Classification and Norms for Hotels of <strong>the</strong> M<strong>in</strong>istry ofTourism conta<strong>in</strong>s hotel classification guidel<strong>in</strong>es for <strong>the</strong> purposes of determ<strong>in</strong><strong>in</strong>g<strong>the</strong> tariffs <strong>the</strong>y are entitled to charge for <strong>the</strong>ir services.Restaurants. Here applies Rule 2116 on Classification and Norms for Restaurantsof <strong>the</strong> M<strong>in</strong>istry of Tourism.Travel Agencies. Law 541 def<strong>in</strong>es <strong>the</strong>se establishments as companies of a commercialnature created with <strong>the</strong> aim of provid<strong>in</strong>g services to tourists or travelersaga<strong>in</strong>st remuneration.Gift Shops. They are currently regulated by Decree 977-02 of 31 December 2002on commercial free zones, which operate as shops for exhibit<strong>in</strong>g and sell<strong>in</strong>ggoods <strong>in</strong> hotels and tourist centers, be<strong>in</strong>g under <strong>the</strong> supervision of <strong>the</strong> M<strong>in</strong>istryof Tourism and <strong>the</strong> Customs Office.Cas<strong>in</strong>os. Law 351 of 1964, as amended by Law 102 of 9 February 1965 andLaw 24-98 of 15 January 1998, regulates <strong>the</strong> grant of licenses for establish<strong>in</strong>gcas<strong>in</strong>os, declar<strong>in</strong>g that this is a way to contribute to <strong>the</strong> promotion of tourismand <strong>the</strong> earn<strong>in</strong>g of funds for <strong>the</strong> development of <strong>the</strong> sector. Licenses are grantedby <strong>the</strong> Executive Power, at <strong>the</strong> request of <strong>the</strong> <strong>in</strong>terested party made to <strong>the</strong>M<strong>in</strong>istry of F<strong>in</strong>ance and prior recommendation of <strong>the</strong> National Commission ofCas<strong>in</strong>os.62
