DOING BUSINESS INTHE DOMINICAN REPUBLICREGULATION OF ASSET EVALUATIONIn order to complement Law 92-04 on Risk Prevention for F<strong>in</strong>ancial Entities, andf<strong>in</strong>ancial activity <strong>in</strong> general, <strong>the</strong> Monetary Board a<strong>do</strong>pted on 31 December 2004<strong>the</strong> “Regulation of Asset Evaluation”.The purpose of this regulation is to establish <strong>the</strong> method that f<strong>in</strong>ancial entitieshave to follow to evaluate, compensate and sanction risks <strong>in</strong> <strong>the</strong>ir assets andreserves.To this effect, it def<strong>in</strong>es <strong>the</strong> criteria, notions, variables and classificationsthat f<strong>in</strong>ancial entities have to follow to evaluate and measure risks <strong>in</strong> <strong>the</strong>ir loanportfolio, <strong>in</strong>vestments, fixed assets, assets received <strong>in</strong> <strong>the</strong> collection of credits,o<strong>the</strong>r assets and reserves. In <strong>the</strong> same way, it sets forth <strong>the</strong> criteria to elim<strong>in</strong>ateor sanction irrecoverable assets from <strong>the</strong> balance sheet.These norms shall apply to <strong>the</strong> follow<strong>in</strong>g f<strong>in</strong>ancial entities,whe<strong>the</strong>r public or private:Multiple BanksSav<strong>in</strong>gs and Credit BanksCredit CorporationsSav<strong>in</strong>gs and Loans AssociationsNational Bank for Promotion of Hous<strong>in</strong>g and ProductionO<strong>the</strong>r f<strong>in</strong>ancial entities that <strong>the</strong> Monetary Board may deem advisable to<strong>in</strong>clude.It should also be mentioned that <strong>the</strong>se rules also apply to f<strong>in</strong>ancial entities stilloperat<strong>in</strong>g as Development Banks, Mortgage Banks or Small F<strong>in</strong>ancial Entities,until <strong>the</strong>ir transformation <strong>in</strong> any of <strong>the</strong> f<strong>in</strong>ancial entities established <strong>in</strong> <strong>the</strong>Monetary and F<strong>in</strong>ancial Law.36
