DOING BUSINESS INTHE DOMINICAN REPUBLICopen bid procedures for all contracts specified <strong>in</strong> <strong>the</strong> agreement. The Chapterdescribes <strong>the</strong> manner of development of <strong>the</strong> bidd<strong>in</strong>g process from <strong>the</strong> start until<strong>the</strong> award of <strong>the</strong> contracts.The Chapter applies to contracts for goods and servicesexceed<strong>in</strong>g <strong>the</strong> amount of US$58,550,000 and to contracts for construction servicesfor more than US$6,725,000.The Chapter on Intellectual Property reaffirms certa<strong>in</strong> provisions already conta<strong>in</strong>ed<strong>in</strong> our <strong>in</strong>ternal legal framework.The most important issues are <strong>the</strong> follow<strong>in</strong>g:1) Ma<strong>in</strong>tenance of <strong>the</strong> patent protection period of 20 years;2) Cause of expiration of patents;3) Preservation of <strong>in</strong>terpretation rules a<strong>do</strong>pted with<strong>in</strong> <strong>the</strong> WTO; and4) Partial application of provisions concern<strong>in</strong>g confidential <strong>in</strong>formation <strong>in</strong> <strong>the</strong>process for obta<strong>in</strong><strong>in</strong>g commercialization permits for pharmaceutical productsand agricultural chemicals, among o<strong>the</strong>r achievements.The Chapter on Conflict Resolution provides <strong>the</strong> guidel<strong>in</strong>es to be used <strong>in</strong> <strong>the</strong> eventof disputes aris<strong>in</strong>g between <strong>the</strong> parties. It creates a similar mechanism than <strong>the</strong>WTO Dispute Resolution system.F<strong>in</strong>ally,o<strong>the</strong>r subjects covered <strong>in</strong> <strong>the</strong> agreement relate to sanitary and phitosanitarymeasures, technical obstacles to trade, telecommunications, electronic commerce,f<strong>in</strong>ancial services, environment, labor and general provisions.DOMINICAN REPUBLIC AND THE WTOAs signatory to <strong>the</strong> Uruguay Round of Negotiations of <strong>the</strong> GATT and member of<strong>the</strong> World Trade Organization (WTO), <strong>the</strong> Dom<strong>in</strong>ican <strong>Republic</strong> is guided, <strong>in</strong> orderto plan <strong>the</strong> process of economic modernization and regional <strong>in</strong>tegration, <strong>in</strong> <strong>the</strong>pr<strong>in</strong>ciples and guidel<strong>in</strong>es a<strong>do</strong>pted by <strong>the</strong> WTO <strong>in</strong> view of liberaliz<strong>in</strong>g worldtrade.The country had also a very active participation at <strong>the</strong> WTO series of m<strong>in</strong>isterialmeet<strong>in</strong>gs held <strong>in</strong> Doha <strong>in</strong> November 2001.One of <strong>the</strong> ma<strong>in</strong> objectives of <strong>the</strong> reform program executed by <strong>the</strong> country is toadapt its legal and economic framework to WTO postulates, so as to ensure itselfa place with<strong>in</strong> <strong>the</strong> process of economic globalization that is tak<strong>in</strong>g place throughout<strong>the</strong> world.This process of adaptation to WTO rules has entailed comprehensive amendments<strong>in</strong> all of <strong>the</strong> fields with <strong>in</strong>fluence on economic activity, such as <strong>in</strong>tellectualproperty and custom tariffs, as well as <strong>in</strong> economic sectors such as tourism,telecommunications, f<strong>in</strong>ancial services, etc.DOMINICAN REPUBLIC AND TAIWANThe Dom<strong>in</strong>ican <strong>Republic</strong> and Taiwan signed a letter of <strong>in</strong>tention for a Free TradeAgreement, <strong>in</strong> order to boost trade and <strong>in</strong>vestment between <strong>the</strong> two countries.The first talks have already started.54
