When a Dom<strong>in</strong>ican citizen substitutes a foreigner <strong>in</strong> anemployment position <strong>the</strong> Dom<strong>in</strong>ican employee will be entitled to <strong>the</strong> samesalary, rights and conditions as <strong>the</strong> foreign employee.Work<strong>in</strong>g periodsThe normal work<strong>in</strong>g week is 44 hours, with a work<strong>in</strong>g day of 8 hours.The usualpractice is to work 40 hours from Monday to Friday and, <strong>in</strong> some companies, <strong>the</strong>rema<strong>in</strong><strong>in</strong>g 4 hours on Saturday.The work<strong>in</strong>g week of part-time employees cannotexceed 29 hours.Paid leaves of absenceMandatory paid leaves of absence are <strong>the</strong> follow<strong>in</strong>g: 5 days <strong>in</strong> <strong>the</strong> event of marriage,3 days <strong>in</strong> <strong>the</strong> event of death of a close family member, and 2 days for <strong>the</strong>worker whose wife gives birth.VacationsPursuant to Law 97-97, workers who have completed one year of employmentare entitled to a paid vacation of 14 work<strong>in</strong>g days.This law extended <strong>the</strong> vacationperiod by almost a week, by declar<strong>in</strong>g that it should be calculated on <strong>the</strong> basis ofwork<strong>in</strong>g days and not calendar days, as set forth <strong>in</strong> <strong>the</strong> Labour Code.Sexual harassmentLabour laws forbid employers or <strong>the</strong>ir representatives to commit actions thatmay be considered as sexual harassment aga<strong>in</strong>st an employee.Maternity protectionThe employer cannot term<strong>in</strong>ate without just cause <strong>the</strong> work contract of a femaleemployee dur<strong>in</strong>g her pregnancy and up to three months after <strong>the</strong> birth.Fur<strong>the</strong>rmore, <strong>in</strong> order to dismiss her with just cause <strong>the</strong> employer must obta<strong>in</strong><strong>the</strong> prior authorisation of <strong>the</strong> M<strong>in</strong>istry of Labour, among o<strong>the</strong>r formalities.101
