DOING BUSINESS INTHE DOMINICAN REPUBLIC16Three permanent members (<strong>the</strong> Governor of <strong>the</strong> Central Bank, who presidesover it, <strong>the</strong> M<strong>in</strong>ister of F<strong>in</strong>ance and <strong>the</strong> Super<strong>in</strong>tendent of Banks)Six members designated by <strong>the</strong> President of <strong>the</strong> <strong>Republic</strong> for a renewabletwo-year-period, not be<strong>in</strong>g able to be removed of <strong>the</strong>ir posts withoutjust cause, and removal may only be decided by majority vote of _ of <strong>the</strong>members of <strong>the</strong> Board.b) Central BankThe Central Bank is a public entity of Public Law with its own legal personality.As <strong>the</strong> only issu<strong>in</strong>g entity, it is granted autonomy under <strong>the</strong> Constitution. It has<strong>the</strong> function to execute monetary, exchange and f<strong>in</strong>ancial policies, pursuant to<strong>the</strong> Monetary Program approved by <strong>the</strong> Monetary Board and by us<strong>in</strong>g <strong>the</strong><strong>in</strong>struments provided <strong>in</strong> <strong>the</strong> law.c) Super<strong>in</strong>tendence of BanksThe Super<strong>in</strong>tendence of Banks has <strong>the</strong> mission to carry out, with full functionalautonomy, <strong>the</strong> supervision of f<strong>in</strong>ancial entities, <strong>in</strong> order to see to <strong>the</strong> complianceof <strong>the</strong>ir legal obligations, requir<strong>in</strong>g <strong>the</strong>m to make <strong>the</strong> relevant risk provisions, tocomply with <strong>the</strong> legal provisions and to impose sanctions. It has also <strong>the</strong> attributionto propose <strong>the</strong> authorizations and revocations of f<strong>in</strong>ancial entities that <strong>the</strong>Monetary Board has to evaluate.d) Guarantees of AutonomyLaw 183-02 sets forth <strong>the</strong> necessary safeguards to ensure that <strong>the</strong> Monetary andF<strong>in</strong>ancial Adm<strong>in</strong>istration carries out its functions <strong>in</strong> an <strong>in</strong>dependent andautonomous manner.Firstly, <strong>the</strong> Adm<strong>in</strong>istration is granted <strong>the</strong> resources required to execute its functionswith budgetary and f<strong>in</strong>ancial <strong>in</strong>dependence (Article 5).Fur<strong>the</strong>rmore, <strong>the</strong> law seeks to streng<strong>the</strong>n <strong>the</strong> professionalism of <strong>the</strong>Adm<strong>in</strong>istration's human resources through a personnel regime that focuses onmerit and professional capability, <strong>in</strong>cludes rules <strong>in</strong>tended to ensure impartiality<strong>in</strong> <strong>the</strong> exercise of <strong>the</strong>ir functions, reaffirms <strong>the</strong> confidentiality duty and creates asevere regime of personal f<strong>in</strong>ancial liability <strong>in</strong> <strong>the</strong> event of misappropriation offunds (Articles 6-8).In addition, <strong>the</strong> law provides special attention to <strong>the</strong> professionalism and <strong>in</strong>dependenceof <strong>the</strong> Adm<strong>in</strong>istration's higher organs <strong>in</strong> order to prevent politicalappo<strong>in</strong>tments and conflicts of <strong>in</strong>terest. For such purpose, it sets out <strong>in</strong> detail <strong>the</strong>selection criteria for a fixed time-period of <strong>the</strong> members of <strong>the</strong> Monetary Board,its compensation regime and grounds of removal, creat<strong>in</strong>g fur<strong>the</strong>rmore statutesfor <strong>the</strong> Central Bank's Governor and <strong>the</strong> Super<strong>in</strong>tendent of Banks.In this same context, <strong>the</strong> mechanisms of monetary transparency, through which<strong>the</strong> Adm<strong>in</strong>istration is obliged to <strong>in</strong>form <strong>the</strong> public of its activities, seek to ensurethat <strong>the</strong> Adm<strong>in</strong>istration performs properly with its duties (Articles 22 and 23).Public protection aga<strong>in</strong>st <strong>the</strong> Adm<strong>in</strong>istration's decisions is reached by virtue ofnew adm<strong>in</strong>istrative and litigious-adm<strong>in</strong>istrative appeals that may be filed by
