Copyrights protection had been ensured by Law 32-86 on IntellectualProperty Rights,which was at <strong>the</strong> time a modern legislation that complied with <strong>the</strong>mandates of <strong>the</strong> Universal Convention on Intellectual Property Rights,to which <strong>the</strong>Dom<strong>in</strong>ican <strong>Republic</strong> is a member. Law 32-86 granted protection to all k<strong>in</strong>ds of creativework, and provided for <strong>the</strong>ir registration with <strong>the</strong> National Office ofCopyright (ONDA), which was entitled to take any measures to ensure <strong>the</strong> protectionof <strong>in</strong>tellectual property rights <strong>in</strong> <strong>the</strong> Dom<strong>in</strong>ican <strong>Republic</strong>.However, <strong>the</strong> protection granted by this legislation was not effective enough toensure an adequate protection of <strong>in</strong>tellectual rights, and <strong>the</strong> Dom<strong>in</strong>ican <strong>Republic</strong>was fac<strong>in</strong>g a lot of <strong>in</strong>ternational pressure to put <strong>in</strong>to force appropriate tools to fightpiracy.Fur<strong>the</strong>rmore, upon becom<strong>in</strong>g a member of <strong>the</strong> WTO, <strong>the</strong> country had to conformits national legislation to <strong>the</strong> provisions of <strong>the</strong> TRIPS agreement.On 21 August 2000 a new Law on Copyright No. 65-00 was passed.The ma<strong>in</strong> purposeof this legislation is to provide a legal and <strong>in</strong>stitutional framework that conformsto <strong>the</strong> TRIPS agreement, and ensures a comprehensive protection of holdersof <strong>in</strong>tellectual property rights <strong>in</strong> <strong>the</strong> Dom<strong>in</strong>ican <strong>Republic</strong> while tak<strong>in</strong>g <strong>in</strong>to account<strong>the</strong> best national <strong>in</strong>terest. Presidential Decree No. 362-01 of 14 March 2001 conta<strong>in</strong>s<strong>the</strong> application regulations of Law 65-00.Fur<strong>the</strong>rmore,<strong>the</strong> country has ratified <strong>the</strong> follow<strong>in</strong>g <strong>in</strong>ternational treaties <strong>in</strong> <strong>the</strong> area:1886 Bern Convention on Protection of Literary and Artistic Works1952 Universal Convention on Copyright.1961 Rome Convention on Protection of Performers,Producers of Phonogramsand Radiobroadcast<strong>in</strong>g.1996 WIPO Copyright Treaty and WIPO Performance and Phonogram Treaty.a) Protected WorksLaw 65-00 protects any orig<strong>in</strong>al <strong>in</strong>tellectual creation,whe<strong>the</strong>r literary,artistic or scientific,that may be fixed, transmitted or copied by any exist<strong>in</strong>g or future pr<strong>in</strong>t<strong>in</strong>g,
