Extradition requests made <strong>in</strong> relation to persons that are<strong>in</strong> <strong>the</strong> Dom<strong>in</strong>ican <strong>Republic</strong> must be sent by <strong>the</strong> Executive Power to <strong>the</strong> SupremeCourt of Justice for <strong>the</strong> tak<strong>in</strong>g of a decision.b) Extradition TreatiesThe Dom<strong>in</strong>ican <strong>Republic</strong> has signed extradition treaties with <strong>the</strong> United Statesand Spa<strong>in</strong>. Fur<strong>the</strong>rmore, <strong>the</strong> country is a member of <strong>the</strong> Inter-AmericanExtradition Convention of 1981.Allow<strong>in</strong>g for a few variations, <strong>the</strong>se treaties have<strong>the</strong> follow<strong>in</strong>g elements:The offense must have a certa<strong>in</strong> importance and lack political motivations.An official request must be made through <strong>the</strong> proper channels.The country mak<strong>in</strong>g <strong>the</strong> request must have jurisdiction to try <strong>the</strong> offence thatmotivates <strong>the</strong> request.The country will be obliged to deliver <strong>the</strong> accused if all conditions are met.The accused cannot be tried or sentenced for a crime different than thatmotivat<strong>in</strong>g <strong>the</strong> extradition.Extradition cannot be granted if <strong>the</strong> statute of limitations for <strong>the</strong> offence hasexpired, or if <strong>the</strong> accused has already been tried and served his sentence.If <strong>the</strong> extradition is requested to serve a sentence,<strong>the</strong> pend<strong>in</strong>g sentence mustbe at least six months.Extradition may be delayed for health problems of <strong>the</strong> accused, or to allow<strong>the</strong> accused to be tried and serve sentence <strong>in</strong> <strong>the</strong> country for any o<strong>the</strong>rcrimes that he may have committed <strong>in</strong> its territory.DEPORTATIONForeigners which undertake any of <strong>the</strong> follow<strong>in</strong>g activities <strong>in</strong> <strong>the</strong> Dom<strong>in</strong>ican territorymay be arrested and deported to <strong>the</strong>ir country of orig<strong>in</strong>:Infr<strong>in</strong>gement of immigration laws, such as illegal entry <strong>in</strong> <strong>the</strong> country, use offalse <strong>do</strong>cuments, stay <strong>in</strong> <strong>the</strong> country after expiration of visa, etc.Subversive activities aga<strong>in</strong>st <strong>the</strong> Dom<strong>in</strong>ican Government.Drug-traffick<strong>in</strong>g.Conviction of a crime with<strong>in</strong> five years after enter<strong>in</strong>g <strong>the</strong> country.Practice of prostitution or related activities.Becom<strong>in</strong>g a public burden with<strong>in</strong> five years after enter<strong>in</strong>g <strong>the</strong> country.The officers charged of <strong>in</strong>vestigat<strong>in</strong>g <strong>the</strong>se cases are <strong>the</strong> immigration <strong>in</strong>spectors,who may request arrest orders to <strong>the</strong> Immigration Director. However, <strong>the</strong> foreignercannot be deported without hav<strong>in</strong>g previously <strong>the</strong> chance to defend himselffrom <strong>the</strong> charges of which he has been accused.135
