The department shall post signs or require signs to be posted prohibiting orlimiting the use of any pool <strong>for</strong> non-compliance with this article. Signs that are property ofthe de partment s hall be r emoved onl y b y t he de partment. N o pe rson m ay e nter t he poolenclosure while the pool is posted “Closed” except an employee or agent of the departmentor other authorized personnel. The pool area shall remain closed until permission to reopenis r equested f rom t he p ermit hol der or authorized a gent <strong>and</strong> p ermission i s g ranted b y t hedepartment.d.) Wastewater discharge. Direct di scharge o f pol luted waters, such as drainage fromoverflow fittings, filter backwash waters or contaminated pool drainage from any pool shallnot be made to any outlet or to any portion of the public storm drain system, or to any naturalstream or to any body of water or ground surface within the jurisdiction of the department,unless otherwise approved by the department.e.) On-site sewage management systems. Any pool <strong>and</strong> related sanitary facilities proposed tobe constructed <strong>and</strong> utilizing an onsite sewage management system must be approved by thedepartment prior to construction <strong>and</strong> in accordance with the state or local county codes.f.) Construction or modification without approval. An y pool c onstructed or modifiedwithout the prior written approval of the department shall be subject to compliance with thisarticle.Part 5 Compliance Requirementsa.) Department inspections. The department shall conduct periodic inspections at each poolto i nsure t hat good ope rating p ractices ar e employed <strong>and</strong> t hat s t<strong>and</strong>ards ar e m aintained i ncompliance with this article. Representatives of the department, after proper identification,shall be pe rmitted t o e nter a ny pool a rea dur ing hour s of op eration f or t he pur pose ofper<strong>for</strong>ming inspections to determine compliance with this article. The department shall orderthe pool permit holder or operator to immediately cease operation whenever the departmentdetermines t hat t he pool r elated facilities <strong>and</strong>/ or appur tenances ar e not i n com pliance w iththis article, or <strong>for</strong> non-payment of fees. Additional inspections of a pool shall be per<strong>for</strong>medas ne cessary to e nsure compliance w ith this a rticle. A fee s hall be ch arged <strong>for</strong> each r e-inspection, after the ini tial a nd follow-up i nspections until t he pool r eceives a compliantinspection. Re-inspection fees must be remitted within thirty (30) days from receipt of theinvoice.b.) Operational renewal. <strong>Pools</strong> operating seasonally are required to have their operationalapproval renewed by undergoing a satisfactory inspection by the department prior to the poolbeing re-opened.c.) Inspection reports. F indings m ade du ring a n i nspection s hall be r ecorded on aninspection report <strong>for</strong>m. The inspection report shall also summarize the requirements of thisarticle.
