SASKPOWER OPEN ACCESS TRANSMISSION TARIFF4 Open Access Same-Time Information SystemTerms and conditions regarding Open Access Same-Time Information System andstandards of conduct are set forth in 18 CFR § 37 of the FERC regulations (Open AccessSame-Time Information System and Standards of Conduct for Public Utilities). TheTransmission Provider’s Standards of Conduct are posted on the OASIS. In the eventavailable transmission capability as posted on the OASIS is insufficient to accommodatea request for firm transmission service, additional studies may be required as provided bythis Tariff pursuant to Sections 19 and 32.5 Interpretation5.1 Applicable Law:This Tariff and any Service Agreements executed hereunder shall be governed byand construed in accordance with the laws of the Province of Saskatchewan andCanada, except where the law of the United States is specifically incorporatedherein. For greater certainty, The United Nations Convention on Contracts for theInternational Sale of Goods as adopted by The International Sale of Goods Act,S.M. 1989-90, c.18, shall not apply to any Service Agreements executedhereunder.5.2 Condition Precedent:The Transmission Provider’s obligation to provide transmission service pursuantto a Service Agreement executed under this Tariff shall be conditional upon thereceipt and continued effectiveness of any regulatory or other approvals requiredby Canadian law in connection with transmission service hereunder.Page | 15
