SASKPOWER OPEN ACCESS TRANSMISSION TARIFFsystems, may defer construction of its new transmission facilities, if the newtransmission facilities on another system cannot be completed in a timely manner.The Transmission Provider shall notify the Transmission Customer in writing ofthe basis for any decision to defer construction and the specific problems whichmust be resolved before it will initiate or resume construction of new facilities.Within sixty (60) days of receiving written notification by the TransmissionProvider of its intent to defer construction pursuant to this section, theTransmission Customer may challenge the decision in accordance with the disputeresolution procedures pursuant to Section 12.22 Changes in Service Specifications22.1 Modifications On a Non-Firm Basis:The Transmission Customer taking Firm Point-To-Point Transmission Servicemay request the Transmission Provider to provide transmission service on a nonfirmbasis over Receipt and Delivery Points other than those specified in theService Agreement or agreed on pursuant to an Umbrella Agreement ("SecondaryReceipt and Delivery Points"), in amounts not to exceed its firm capacityreservation, without incurring an additional Non-Firm Point-To-PointTransmission Service charge or executing a new Service Agreement, subject tothe following conditions:(i)Service provided over Secondary Receipt and Delivery Points will be nonfirmonly, on an as-available basis and will not displace any firm or non-Page | 58
