Upon receipt of an executed Facilities Study Agreement, theTransmission Provider will use due diligence to complete the required FacilitiesStudy within a sixty (60) day period. If the Transmission Provider is unable tocomplete the Facilities Study in the allotted time period, the TransmissionProvider shall notify the Eligible Customer and provide an estimate of the timeneeded to reach a final determination along with an explanation of the reasons thatadditional time is required to complete the study. When completed, the FacilitiesStudy will include a good faith estimate of: (i) the cost of Direct AssignmentFacilities to be charged to the Eligible Customer; (ii) the Eligible Customer'sappropriate share of the cost of any required Network Upgrades; and (iii) the timerequired to complete such construction and initiate the requested service. TheEligible Customer shall provide the Transmission Provider with a letter of creditor other reasonable form of security acceptable to the Transmission Providerequivalent to the costs of new facilities or upgrades consistent with commercialpractices as established under the laws of Canada and the Province ofSaskatchewan. The Eligible Customer shall have thirty (30) days to execute aService Agreement and provide the required letter of credit or other form ofsecurity or the request no longer will be a Completed Application and shall bedeemed terminated and withdrawn.Page | 80
