______________________________________________________________________________________186 (1<strong>151</strong>) GENERAL COMMERCIAL ZONE – 100 NICHOLAS AVENUEDespite the provisions <strong>of</strong> By-<strong>law</strong> <strong>2005</strong>-150, the lands described as a portion <strong>of</strong> Lot 7 and all <strong>of</strong> Lots 8 and 9in the Acciavati Subdivision and having civic addresses 100 and 100A Nicholas Avenue and marked“subject property – Block B” on the map attached as Schedule 1153 may be used to permit uses permittedin the General Commercial Zone (C4), subject to the following conditions:1. Existing – 16 dwelling units located in 2 buildings2. Future buildingsa. The building setback from the property line <strong>of</strong> the subject property adjacent theapartments located to the east is set at 3.1mb. The building setback from the north property line at 96 Nicholas Avenue shall be at least7.62m and that setback shall be used for landscaping onlyc. The building setback for any future building located on the subject property fromNicholas Avenue shall be 4.572m.Schedule No. 1153 to By-<strong>law</strong> 2002-161______________________________________________________________________________________187 (1155) GENERAL COMMERCIAL ZONE 310 DACEY ROADDespite the provisions <strong>of</strong> By-<strong>law</strong> <strong>2005</strong>-150, the lands described as a portion <strong>of</strong> Lot 7, RCP H-708, part 1 onPlan 1R-10382 which lands are located on the east side <strong>of</strong> Dacey Road approximately 335m south <strong>of</strong> itsintersection with Trunk Road and having Civic No. 310 Dacey Road which lands are shown outlined andmarked “subject property” on the map attached as Schedule NO. 1157 hereto may be used, in addition touses permitted in a General Commercial Zone (C4), for the following permitted uses:1. Personal storage2. Recreational facilities3. Commercial school4. Drug store with less then 233m 2 gross floor area5. Repair and maintenance services with less then 139.3m 2 gross floor area6. Dwelling units are permitted on any floor <strong>of</strong> any building, so long as they conform to the MediumDensity Residential Zone (R4) regulations, as outlined in Section 9.8 <strong>of</strong> Zoning By-<strong>law</strong> <strong>2005</strong>-150{2006-79}Subject to the following <strong>special</strong> conditions1.
