______________________________________________________________________________________12 (222) THE ALGOMA STEEL CORPORATION LTD.; UNION CARBIDE CANADALTD; ALGOMA CENTRAL RAILWAY; M2 ZONES LOCATED WEST OF WESTSTREET, NORTH OF CATHCART STREETOn the lands described as part <strong>of</strong> Broken Northwest Quarter <strong>of</strong> Section 1 former Township <strong>of</strong> Awenge, part<strong>of</strong> Broken Northeast Quarter Section 2 former Township <strong>of</strong> Awenge, part <strong>of</strong> Broken Southwest QuarterSection 36 former Township <strong>of</strong> Korah and part <strong>of</strong> Block 1 <strong>of</strong> the Stewart Survey <strong>of</strong> the Korah Blocks, nowin the City <strong>of</strong> Sault Ste. Marie, located west <strong>of</strong> West Street and north <strong>of</strong> Cathcart Street, which lands areshown outlined and marked as Blocks “A”, “B” and “C” on schedule 225 hereto, the uses as hereinafterdenoted for each block are permitted uses in such Block in addition to the uses permitted in By-<strong>law</strong> <strong>2005</strong>-150, subject to the <strong>special</strong> regulations set out therefore and subject to section 5 <strong>of</strong> this By-<strong>law</strong>:1. BLOCK “A”: The Algoma Steel Corporation – Additional Permitted Usesa. A driveway or walkwayb. A gate house, provided such gate house is not closer to the west limit <strong>of</strong> West Street than15.24m;c. A non-animated sign attached to a gate house identifying the industry carried out on thepremises, provided such sign does not exceed 7.62m in height;d. An <strong>of</strong>fice building, environmental control laboratory, general <strong>of</strong>fice building, transformeror electrical substation, warehouse or other storage building providedi. No building is closer to the west limit <strong>of</strong> West Street than 9.1m;ii. Any transformer or electrical substation is screened along the front and sides <strong>by</strong>a 100% visually solid fence, berm, hedge or any combination there<strong>of</strong>, having aminimum height <strong>of</strong> 1.83m;e. A parking lot, provided such lot is not closer to the west limit <strong>of</strong> West Street than 7.62m;f. Other similar service uses accessory to the making <strong>of</strong> <strong>ste</strong>el; All <strong>of</strong> which shall be subjectto the following building regulations;i. Maximum height: 15.24mii. M2 Lot Regulation Exceptions1. Maximum lot coverage – none2. Minimum rear yard – none2. BLOCK “B”: Union Carbide Canada Limiteda. Non-conforming useThe land, buildings or structures that comprise the tonnage oxygen plant, and were<strong>law</strong>fully used for the production <strong>of</strong> tonnage oxygen on the 9 th day <strong>of</strong> January, 1973, shallbe deemed to be a <strong>law</strong>ful non-conforming use under this <strong>by</strong>-<strong>law</strong>, regardless <strong>of</strong> the length<strong>of</strong> time or number <strong>of</strong> times that the tonnage oxygen plant, or any part there<strong>of</strong> may be shutdown; andb. Reconstruction <strong>of</strong> any non-conforming building or structure mentioned in the precedingclause a that is damaged <strong>by</strong> causes beyond the reasonable control <strong>of</strong> the owner shall bepermitted providedi. Such damage does not exceed 50% <strong>of</strong> the replacement value <strong>of</strong> the tonnageoxygen plant; andii. Such reconstruction will not increase the height, size or volume <strong>of</strong> any building,machinery or structure that comprises any part <strong>of</strong> the said plant.c. Additional Permitted Usesi. A plant for the production <strong>of</strong> acetylene, hydrogen, and/or liquid oxygen;ii. Two only gas cylinder filling stations and associated equipmentiii. Storage <strong>of</strong> manufactured gases and accessory uses; andiv. Accessory uses to the above; All <strong>of</strong> which shall be subject to the followingreplacement regulations:v. Maximum lot coverage: nonevi. Maximum building height: height <strong>of</strong> existing building on the day <strong>of</strong> the passing<strong>of</strong> this By-<strong>law</strong>vii. Minimum front and side yards: existing front and side yards on the day <strong>of</strong> thepassing <strong>of</strong> this By-<strong>law</strong>viii. Minimum rear yard – noned.
