_____________________________________________________________________________________314 415 NORTHLAND ROADZoning By-<strong>law</strong> not yet finalized.______________________________________________________________________________________315 131 SECOND LINE EASTDespite the provisions <strong>of</strong> By-<strong>law</strong> <strong>2005</strong>-150, the lands located at 131 Second Line East and marked“subject property” on the map attached is rezoned to R.2.-H.S (Single Detached Residential) with a“Holding Provision” subject to the following conditions:1. That access to Second Line east be prohibited.Pursuant to Section 36 <strong>of</strong> the Planning Act, the Holding Provision may be removed provided that thefollowing issues are addressed through a geotechnical study, to the satisfaction <strong>of</strong> City Council:a. The study must be conducted <strong>by</strong> a geotechnical <strong>special</strong>ist whose credentials must be approved<strong>by</strong> the Commissioner <strong>of</strong> Engineering and Planning or his designate. The study shall addressslope stability including the stability <strong>of</strong> slopes upon the subject property, as well as anypossible impacts to abutting properties and/or structures. The study shall also address anypossible impacts to the Fort Creek Flood Channel located at the bottom <strong>of</strong> the ravine;b. The study shall address soil bearing capa<strong>city</strong> in relation to the construction <strong>of</strong> the residence,attached garage, driveway and any other proposed structures upon the Subject Property;c. The study shall also include a review <strong>of</strong> any additional concerns, which in the opinion <strong>of</strong> thegeotechnical <strong>special</strong>ist, should be addressed;d. The study shall include recommendations aimed at ensuring long term slope stability upon theSubject Property and adjacent lands. This shall include any ongoing maintenance or reviewrequired <strong>by</strong> the homeowner to ensure continued slope stability; ande. The study shall include any recommendations deemed appropriate <strong>by</strong> the geotechnical<strong>special</strong>ist, relating to on-site construction supervision to ensure that the recommendations <strong>of</strong>the report are adhered to.Schedule 315 to By-<strong>law</strong> 2012-124______________________________________________________________________________________171
