led to convictions based on this broad interpretation of the norm. e changes made<br />
with the latest amendment can be better understood by comparing the new Article<br />
301 with the former version, came into force in 2005 22 , which established that:<br />
1. A person who publicly denigrates Turkishness, the Republic or the Grand National<br />
Assembly of Turkey shall be punished by imprisonment for a term of six months to three<br />
years.<br />
2. A person who publicly denigrates the Government of the Republic of Turkey, the judicial<br />
bodies of the State or the m<strong>il</strong>itary or security organizations of the State shall be punished<br />
by imprisonment for a term of six months to two years.<br />
3. In cases where denigration of Turkishness is committed by a Turkish citizen in a foreign<br />
country the punishment shall be increased by one third.<br />
4. Expressions of thought for the purpose of criticism shall not constitute a crime.<br />
e rst change, which even a supercial reading reveals, is the replacement of<br />
the term «Turkishness» (Türklük) with the term «Turkish Nation» (Türk M<strong>il</strong>leti).<br />
Although the former term is interpreted as synonymous with the latter in the legal<br />
doctrine 23 , the term Turkishness as it is dened in the ocial Commentary to the<br />
TPC was problematic in regard of the lex certa principle, for it was a vague concept<br />
24 that bears a resemblance to the term «Italianità», which is an ethno-cultural<br />
concept 25 . e term Turkish Nation is thought to be clearer since it is based on<br />
the criterion of citizenship to the Turkish State which is comparable with the Italian<br />
«Nazione» or the German «Staatsvolk», which are less metaphysical and obscure<br />
concepts than Volk, Italianità or Türklük. 26 e other conceptual change that is of<br />
minor importance is the crystallization of the term «Republic» (Cumhuriyet) as “the<br />
State of Republic of «Turkey» (Türkiye Cumhuriyeti Devleti). e amendment also<br />
