الملخص
ركزت ىذه الدراسة على موضوع تسجيل العالمة التجارية ضرورة ملحة لنشوء احلق فيها يف كل من القانوف االردين
واجلزائري والفرنسي . دلعرفة مد ضرورة تسجيل العالمة التجارية لنشوء احلق فيها سواء يف ضل التقد التقٍت يف رلاؿ
التجارة أ يف الواقع التقليدي . من خالؿ الوقوؼ على موقف التشريعات زلل الدراسة ،

اليت تتمتع هبا العالمة التجارية ادلسجلة اضافة اىل احلماية ادلدنية اليت تتمتع هبا مجيع احلقوؽ . وبالتايل فاف نظا االستعماؿ

Abstract
This study focused on the topic of the importance of registrating the trademark to to
claim its ownership the Jordanian, Algerian and French law .In order to know the
importance of registrating the trademark to claim its ownership either in the light of
technical progress in the field of commerce or in traditional reality . Through studying the
position of the legislation regarding the system of registrating the trademark. The Algerian
and French legislators took the system of registration to create the right of ownership of the
trademark. While the Jordanian legislator took by
priority. The study concluded that the registration's system is better than the system of use
regarding the advantages that it has the most important of which is the penal protection that
the trademark has in addition to civil protection that it has all rights. So , the system of use
excludes the trade mark from the circle of penal protection which will weaken the system
of protecting the trademark a lot. So , the Jordanian legislator should modify his legal texts
so that it makes the basis of owning the trademark its registration since it provides many
advantages .
