ألصحاب ىاتو األعمال حبقوقهم الفكرية يف أن تنسب إليهم أعماعتم،‏ بيد أن ىذا االعًتاف ليس كافيا إليفائهم حقهم بل
البد من زتاية عتاتو اضتقوق.‏
ومنو فتعد اضتقوق الفكرية حقوقا ناجتة عن أنشطة فكرية يف اجملاالت الصناعية والعلمية واألدبية والفنية إذ تقسم
لقسمُت رئيسيُت األول يتعلق باظتلكية الصناعية واليت تضم االبتكارات بأنواعها من براءات االخًتاع والعالمات التجارية...‏
إذل غَت ذلك،‏ أما الثاين فيتعلق باظتلكية األدبية و الفنية و اظتتمثلة يف حقوق اظتؤلف و ما يلحقها من حقوق غتاورة.‏
وألجل ذلك صتأت العديد من الدول إذل التفكَت وجبدية يف وجوب زتاية اصتانب الفكري يف اإلنسان ألنو بدون
زتاية يشيع التقليد وتنتشر احملاكاة على حساب اإلبداع و االبتكار فاضتماية ضرورة ال سبيل لالستغناء عنها يف غتتمع
اظتعرفة اظتعاصر ‏،و اصتزائر كغَتىا من الدول سارعت إذل ضرورة زتاية ىذا اضتق وصونو سواء كان ذلك مدنياً‏ أم جنائياً.‏
Abstract :
It is no secret to us that information is one of the human fruits that later turns into a
stock of knowledge from which humanity derives everything it needs to facilitate the ways
of life for it, and from it this service that humans provide to each other necessitated
recognition of the owners of these works of their intellectual rights to be attributed to them
for their works. However, this recognition is not sufficient to fulfill their right, but rather
these rights must be protected.
Hence, intellectual rights are rights resulting from intellectual activities in the
industrial, scientific, literary and artistic fields, as they are divided into two main sections.
The first relates to industrial property, which includes innovations of all kinds, such as
patents, trademarks, etc., and the second relates to literary and artistic property, and of
copyright and related rights.
For this reason, many countries have resorted to thinking seriously about the
necessity of protecting the intellectual aspect of man, because without protection imitation
