ملخص:‏
إف استخدا حقوؽ ادللكية الفكرية خاصة حقوؽ ادللكية الصناعية على غرار العالمات التجارية و براءات االخًتاع
والرسو و النماذج الصناعية خاصة مع الدور الذي تقو بو ادلؤسسات اليت تشرؼ على ىذه احلقوؽ،‏ وعليو فإف مسألة
محاية ىذه احلقوؽ سيكوف لو بالضرورة أثرا على ادلستهلك باعتباره متضررا عند سوء استخدا تلك احلقوؽ من قبل
أصحاهبا عند محاية حقوقهم من كل التجاوزات اليت قد يتعرضوف ذلا عند شلارسة النشاط االقتصادي،‏ وتبدو أعليتو دراسة
ادلوضوع يف خصوصية األثر الذي يتضرر منو ادلستهلك عند عملية اقتناء حاجياتو من السلع واخلدمات و اليت ذلا عالقة
بعناصر ادللكية الصناعية.‏
وعلى ذلك توصلنا اىل كوف تلك االعتداءات على ىذه العناصر من تقليد و اعتداء،‏ كما يتضرر منها أصحاب تلك
العناصر فإهنا تطاؿ أيضا ادلستهلك بطريق مباشر أو غري مباشر،‏ و يبقى دور ادلؤسسات اليت تشرؼ على محاية عناصر
ادللكية الصناعية أىم العوامل اليت ربافظ على مصاحل أصحاهبا ومصاحل ادلستهلك أيضا.‏
Abstract:
The use of intellectual property rights, especially industrial property rights, such as
trademarks, patents, fees and industrial designs, especially with the role played by the
institutions that oversee these rights, and therefore the protection of these rights will
necessarily have an impact on the consumer as being affected when these rights are misused
by their owners as they protect their rights against any abuses that they may suffer during
the economic activity, and its importance seems to be important to examine the subject in
the private life of the impact. What makes the consumer affected when acquiring his goods
and services, which are related to the elements of industrial property.
We have therefore concluded that these attacks on these elements are imitations and
assaults, as well as those affected by them, they also affect the consumer directly or
indirectly, and the role of the institutions that oversee the protection of industrial property
elements remains the most important factor that safeguards the interests of their owners and
the consumer.
