ملخص:‏
تعد اتفاقية تريبس إحدى أىم اتفاقيات ادلنظمة العادلية للتجارة،‏ بالنظر للنظام الذي اعتمدتو يف محاية حقوق ادللكية
الفكرية بصفة عامة،‏ والرباءات الدوائية بصفة خاصة.‏
يثار مؤخرا تساؤالت كثَتة حول احلماية القانونية اليت منحت لرباءات االخًتاع الدوائية يف ظل اتفاقية تريبس،‏ واليت
امتدت على ضلو مل يعد يضمن أدٌل معايَت التوازن بُت حقوق أصحاب ىذه الرباءات من جهة،‏ ومن جهة ثانية حقوق من
حيتاجون إىل االستفادة منها يف الدول النامية،‏ يف ظل سيطرة شركات األدوية العادلية على سوق الدواء،‏ وذباىلها أدٌل
اعتبارات الصحة العامة.‏ وىو ما ذبسد مع تفشي فَتوس كورونا ادلستجد.‏
تتتناول ىذه الدراسة إشكالية احلماية ادلشددة ادلقررة يف اتفاقية تريبس ومدى تأثَتىا على الدول النامية يف مواجهة
تداعيات فَتوس كورونا من حيث قدرهتا على احلصول على الدواء واللقاح والعتاد الطيب.‏
Abstract :
The TRIPS Agreement is one of the most important agreements of the World Trade
Organization, given the system it adopted in protecting intellectual property rights in
general, and pharmaceutical patents in particular.
Recently, many questions have been raised about the legal protection granted to
pharmaceutical patents under the TRIPS Agreement, which extended in a way that no
longer guarantees the lowest standards of balance between the rights of these patent holders
and the rights of those who need to benefit from them in developing countries, in light of
Global pharmaceutical companies dominate the drug market, ignoring the slightest
considerations of public health. This was exemplified by the outbreak of the new Corona
virus.
This study deals with the problem of strict protection established in the TRIPS
Agreement and its impact on developing countries in the face of the repercussions of the
Corona virus in terms of their ability to obtain medicine, vaccines and medical equipment.
