52 Elizabeth Murno What Happens After a Protection Order Has Expired? As the expiration date of a final protection order approaches, a victim may seek to have it extended. A relatively unknown and infrequently used provision of the Family Court Act states that a protection order may be extended for a reasonable time if special circumstances exist. 67 The limited case law interpreting this provision deals exclusively with the issue of whether a hearing is necessary and fails to expound on the definition of special circumstances, 68 so practitioners are free to make creative and persuasive arguments to warrant extending an order.
