63. The American Psychological Association determined that, “although there<br />

are no data to support the phenomenon called parental alienation syndrome,<br />

the term is still used by some evaluators and courts to discount children’s<br />

fears in hostile and psychologically abusive situations. Psychological<br />

evaluators not trained in domestic violence may contribute to this process<br />

by ignoring or minimizing the violence and by giving pathological labels to<br />

women’s responses to chronic victimization. Terms such as ‘parental<br />

alienation’ may be used to blame the women for the children’s reasonable<br />

fear of or anger toward their violent father.” Report on Violence and the<br />

64. No cases were found in New York allowing for the admission of expert<br />

testimony on parental alienation syndrome. People v Loomis 172 Misc 2d<br />

265 (Crim Ct, NY County, 1997). That court also noted that in Florida, such<br />

testimony was not generally accepted under the Frye rule; see also Darla N.<br />

v Christine N., 289 AD2d 1012 (4th Dept 2001); Zafran v Zafran, 191 Misc<br />

2d 60 (Sup Ct, Nassau County, 2002); JF v LF, 694 NYS2d 592.<br />

65. Some states, though, have a presumption that the abusive parent have only<br />

supervised visits unless he can rebut the presumption by showing he is fit<br />

to have unsupervised visits, for example, by completing a batterer’s<br />

education program.<br />
