Regulatory Setting<br />

Many state and federal laws regulate impacts to wildlife. The U.S. Fish and Wildlife<br />

Service, the National Oceanographic and Atmospheric Fisheries Service, and the<br />

<strong>California</strong> Department <strong>of</strong> Fish and Game are responsible for implementing these laws.<br />

This section discusses potential impacts and permit requirements associated with wildlife<br />

not listed or proposed for listing under the state or Federal Endangered Species Act. All<br />

other special-status animal species are discussed here, including <strong>California</strong> Department <strong>of</strong><br />

Fish and Game fully protected species and species <strong>of</strong> special concern, and the U.S. Fish<br />

and Wildlife Service or National Oceanographic and Atmospheric Fisheries Service<br />

candidate species.<br />

Federal laws and regulations pertaining to wildlife include the following:<br />

• National Environmental Policy Act<br />

• Migratory Bird Treaty Act<br />

• Fish and Wildlife Coordination Act<br />

• Marine Mammal Protection Act<br />

<strong>State</strong> laws and regulations pertaining to wildlife include the following:<br />

• <strong>California</strong> Environmental Quality Act<br />

• Sections 1601 – 1603 <strong>of</strong> the Fish and Game Code<br />

• Sections 4150 and 4152 <strong>of</strong> the Fish and Game Code<br />

For projects within the Coastal Zone, consult the regulations and policies <strong>of</strong> either the<br />

Coastal Commission or the Bay Conservation and Development Commission, as<br />

applicable.<br />

Affected Environment<br />

Areas within the project limits are generally disturbed and provide poor quality habitat<br />

for wildlife. Species observed during field reviews include western fence lizards<br />

(Sceloporus occidentalis), western gulls (Larus occidentalis) and <strong>California</strong> gulls (Larus<br />

californicus).<br />
