proposed project would occur within existing right-<strong>of</strong>-way, A portion <strong>of</strong> the existing<br />

parking at the Cliff House Inn in Mussel Shoals is located on Old Coast Highway.<br />

Implementation <strong>of</strong> the BUILD alternative may result in the loss or temporary loss <strong>of</strong><br />

parking in front <strong>of</strong> the Cliff House Inn.<br />

Avoidance, Minimization and/or Mitigation Measures<br />

Based on the above discussion and analysis, the implementation <strong>of</strong> the proposed project<br />

would not cause substantial impacts to public services within the study area.<br />

• If protection or relocation <strong>of</strong> the utilities would be required, early coordination and<br />

communication with the utility provider would occur so there would be no disruption<br />

<strong>of</strong> services.<br />

• For loss <strong>of</strong> private parking spaces, the property owner would be compensated.<br />

2.1.9 Environmental Justice<br />

Regulatory Setting<br />

All projects involving a federal action (funding, permit, or land) must comply with<br />

Executive Order 12898, Federal Actions to Address Environmental Justice in Minority<br />

Populations and Low-Income Populations, signed by President Bill Clinton on February<br />

11, 1994. This Executive Order directs federal agencies to take the appropriate and<br />

necessary steps to identify and address disproportionately high and adverse impacts <strong>of</strong><br />

federal projects on the health or environment <strong>of</strong> minority and low-income populations to<br />

the greatest extent practicable and permitted by law. Low income is defined based on the<br />

Department <strong>of</strong> Health and Human Services poverty guidelines. For 2008, this was<br />

$21,200 for a family <strong>of</strong> four.<br />

All considerations under Title VI <strong>of</strong> the Civil Rights Act <strong>of</strong> 1964 and related statutes<br />

have also been included in this project. The Department’s commitment to upholding the<br />

mandates <strong>of</strong> Title VI is evidenced by its Title VI Policy <strong>State</strong>ment, signed by the<br />

Director, which can be found in Appendix C <strong>of</strong> this document.<br />

Affected Environment<br />

As shown in Table 2.1-8, none <strong>of</strong> the affected communities have markedly higher levels<br />

<strong>of</strong> non-white or Hispanic populations compared to the surrounding region with the<br />

exception <strong>of</strong> the southern area <strong>of</strong> Carpinteria. In the Rincon area, La Conchita, and<br />

Mussel Shoals, the total non-white population is much lower than the Ventura County<br />
