CITY OF DAVIS MUNICIPAL CODE CHAPTER 32: MANAGEMENT OF GARBAGE, OTHER<br />
WASTES, RECYCLABLES, AND FEES THEREFOR<br />
Article 32.01 IN GENERAL<br />
32.01.0<strong>10</strong> Definitions.<br />
For the purpose <strong>of</strong> this chapter, the following words and phrases shall have the meanings respectively ascribed<br />
to them by this section:<br />
Business and commercial waste. Solid waste comprised <strong>of</strong> combustible and noncombustible packaging<br />
materials, waste paper, fabrication wastes, discarded parts from repair operations and similar waste materials,<br />
excluding garbage waste, that are produced by stores, shops and businesses in the course <strong>of</strong> their operation.<br />
Communally serviced residence. Apartments, quadruplexes, condominiums, mobile home parks and other<br />
resident occupancies at which wastes from individual resident units are commingled in a common container or a<br />
group <strong>of</strong> containers.<br />
Construction debris waste. Concrete, brick wastes, dirt, scrap lumber, wallboard, pipe, wiring and packaging<br />
materials generated by the construction, repair, remodel, modification, demolition or removal <strong>of</strong> buildings or<br />
structures.<br />
Garbage waste. Kitchen and table <strong>of</strong>fal and every accumulation <strong>of</strong> animal, vegetable and other matter that<br />
attends the preparation, consumption, decay or dealing in or storage <strong>of</strong> meats, fish, fowl, fruits or vegetables.<br />
Food slops or liquids, when placed in a plastic liner within the garbage container, shall be considered as garbage<br />
waste. Garbage waste shall also include cans, bottles, containers, wrappings and packaging materials soiled with<br />
foods and waste material.<br />
Hazardous waste. <strong>Waste</strong> defined as hazardous by Public Resources Code Section 40141 as it now exists or<br />
may subsequently be amended; namely, a waste or combination <strong>of</strong> wastes which, because <strong>of</strong> its quantity,<br />
concentration, toxicity, or physical, chemical or infectious characteristics, may do either <strong>of</strong> the following: (1)<br />
cause or significantly contribute to, an increase in mortality or an increase in serious irreversible, or<br />
incapacitating reversible, illness; (2) pose a substantial present or potential hazard to human health or<br />
environment when improperly treated, stored, transported, or disposed <strong>of</strong>, or otherwise managed. “Hazardous<br />
waste” includes extremely hazardous waste and acutely hazardous waste, and any other waste as may hereafter<br />
from time to time be designated as hazardous by the Environmental Protection Agency (“EPA”) or other agency<br />
<strong>of</strong> the United States government, or by the California legislature or any agency <strong>of</strong> the State <strong>of</strong> California<br />
empowered by law to classify or designate waste as hazardous, extremely hazardous or acutely hazardous.<br />
Household waste. Packaging material not associated with food products, discarded clothing, furniture, small<br />
appliances, toys and other waste material generated in the course <strong>of</strong> residential living. Ashes and excrement<br />
(disposable diapers, cat litter, and dog droppings) are considered a household waste when placed inside a plastic<br />
liner within the garbage container.<br />
DRAFT<br />
Individually serviced residence. Single-family houses, each dwelling unit <strong>of</strong> a duplex, triplex, quadruplex,<br />
mobile home park, condominium or other residence facility at which wastes are stored and made available for<br />
collection by or at each individual residence unit.<br />
Industrial waste. <strong>Waste</strong>s produced in large quantities from factories, industrial plants, and mining plants.<br />
Occupancy. Individually serviced and communally serviced residences, governmental, business and<br />
commercial establishments, factories and other industrial plants and any other development or premises on a<br />
parcel <strong>of</strong> land.<br />
