(a) To the extent possible, multifamily complexes must site three recycling carts within, or next to, each trash<br />

enclosure.<br />

(b) Any project which proposes to site fewer than three carts per enclosure shall submit written explanation as<br />

to the basis for requesting an exemption. The planning and building department in consultation with the public<br />

works department shall make the determination <strong>of</strong> whether or not the exemption should be granted. (Ord. 1765<br />

§ 1)<br />

32.03.050 Education.<br />

(a) Each container for recyclable material shall identify which materials are acceptable for that container.<br />

(b) At the time a lease or rental agreement is signed, the manager or homeowner’s association representative,<br />

or other appropriate agent <strong>of</strong> the owner or owners <strong>of</strong> each communally serviced residence or multitenant<br />

commercial complex that is subject to this section shall:<br />

(1) Inform all new tenants <strong>of</strong> the availability <strong>of</strong> recycling, the location <strong>of</strong> the recycling collection site(s), and<br />

the materials that may be recycled; and<br />

(2) Provide all new tenants with a flyer describing the city’s recycling program. The flyers shall be provided<br />

by the city. (Ord. 1765 § 1)<br />

Article 32.04 DIVERSION OF CONSTRUCTION AND DEMOLITION DEBRIS<br />

32.04.0<strong>10</strong> Short title.<br />

This article shall be known as the “Diversion <strong>of</strong> Construction and Demolition Debris Ordinance <strong>of</strong> the <strong>City</strong> <strong>of</strong><br />

Davis.” (Ord. 2299 §1, 2007)<br />

32.04.020 Definitions.<br />

For the purpose <strong>of</strong> this article the following terms shall have the meanings given in this section:<br />

(a) Applicant means any individual, firm, limited liability company, association, partnership, political<br />

subdivision, industry, public or private corporation, or any other entity whatsoever who applies to the city for<br />

applicable permits to undertake any construction, demolition, or renovation project within the city.<br />

(b) Contractor means any person or entity holding, or required to hold, a contractor’s license <strong>of</strong> any type<br />

under the laws <strong>of</strong> the State <strong>of</strong> California, or who performs (whether as a contractor, subcontractor or ownerbuilder)<br />

any construction, demolition, remodeling, or landscaping service relating to buildings or accessory<br />

structures within the city.<br />

(c) Construction means the building <strong>of</strong> any facility or structure or any portion there<strong>of</strong> including any tenant<br />

improvements to an existing facility or structure.<br />

(d) Construction and demolition debris includes:<br />

(1) Discarded materials generally considered to be not water soluble and nonhazardous in nature, including<br />

but not limited to metals, glass, brick, concrete, asphalt material, pipe, gypsum, wallboard, and/or lumber,<br />

generated as part <strong>of</strong> a construction, demolition or renovation project; <strong>of</strong> a structure and/or landscaping, and<br />

including rocks, soils, tree remains, trees, and other vegetative matter that normally results from land clearing,<br />

landscaping and development operations for a construction or demolition project;<br />

(2) Clean cardboard, paper, plastic, wood, and metal scraps resulting from any construction or demolition<br />

project;<br />

(3) Other nonhazardous wastes that are generated at construction or demolition projects, provided such<br />

amounts are consistent with best management practices <strong>of</strong> the industry.<br />

(e) Demolition means the decimating, razing, tearing down or wrecking <strong>of</strong> any facility structure, pavement or<br />

building, whether in whole or in part, whether interior or exterior.<br />

(f) Divertible materials includes:<br />

(1) Masonry building materials generally used in construction including, but not limited to, asphalt, concrete,<br />

rock, stone, and brick;<br />
