Recommendations<br />
Introduction<br />
The International Jo<strong>in</strong>t Commission is prepar<strong>in</strong>g advice<br />
to <strong>the</strong> Parties on future form and content of <strong>the</strong> <strong>Great</strong><br />
<strong>Lakes</strong> Water Quality Agreement. <strong>Groundwater</strong> was<br />
one of <strong>the</strong> priority issues adopted by <strong>the</strong> Commission<br />
for <strong>the</strong> 2005-2007 biennial cycle, and <strong>the</strong> <strong>Great</strong><br />
<strong>Lakes</strong> Science Advisory Board wishes to advise <strong>the</strong><br />
Commission of its op<strong>in</strong>ion concern<strong>in</strong>g <strong>the</strong> attention<br />
given to groundwater <strong>in</strong> <strong>the</strong> redraft<strong>in</strong>g of <strong>the</strong> <strong>Great</strong><br />
<strong>Lakes</strong> Water Quality Agreement.<br />
This letter presents a brief summary of <strong>in</strong>formation and<br />
analysis obta<strong>in</strong>ed to date by <strong>the</strong> SAB on groundwater<br />
issues <strong>in</strong> <strong>the</strong> <strong>Great</strong> <strong>Lakes</strong> Bas<strong>in</strong>. Toward its objective<br />
of produc<strong>in</strong>g a 2007 Status of <strong>the</strong> <strong>Great</strong> <strong>Lakes</strong> Bas<strong>in</strong><br />
<strong>Groundwater</strong> Report, an expansion and update to earlier<br />
IJC reports that have dealt with groundwater, <strong>the</strong> SAB<br />
has conducted two expert consultations on <strong>the</strong> topic:<br />
one <strong>in</strong> Lans<strong>in</strong>g, Michigan, on March 8-9, 2006, and one<br />
<strong>in</strong> Syracuse, New York, on June 13-14, 2006. A third<br />
consultation is scheduled for November 3, 2006, <strong>in</strong><br />
conjunction with SOLEC <strong>in</strong> Milwaukee, Wiscons<strong>in</strong>.<br />
The three consultations will form <strong>the</strong> basis of <strong>the</strong> report<br />
to be issued <strong>in</strong> 2007. The SAB has had only limited<br />
opportunity to review <strong>the</strong> results of <strong>the</strong> two consultations<br />
and anticipates that <strong>the</strong> third expert consultation<br />
will provide fur<strong>the</strong>r f<strong>in</strong>d<strong>in</strong>gs about groundwater issues<br />
<strong>in</strong> <strong>the</strong> <strong>Great</strong> <strong>Lakes</strong> Bas<strong>in</strong>. While <strong>the</strong> recommendations<br />
presented here<strong>in</strong> must be considered prelim<strong>in</strong>ary, <strong>the</strong>re<br />
has been substantial agreement <strong>in</strong> <strong>the</strong> two consultations<br />
on <strong>the</strong> importance of, and challenges to, groundwater<br />
<strong>in</strong> relation to water quality <strong>in</strong> <strong>the</strong> <strong>Great</strong> <strong>Lakes</strong><br />
Bas<strong>in</strong>. It is on <strong>the</strong> basis of this consensus that <strong>the</strong> SAB<br />
offers prelim<strong>in</strong>ary recommendations.<br />
Prelim<strong>in</strong>ary SAB Recommendations on<br />
<strong>Groundwater</strong> Issues<br />
The follow<strong>in</strong>g prelim<strong>in</strong>ary recommendations are, for <strong>the</strong><br />
most part, a re<strong>in</strong>forcement of <strong>the</strong> content and direction of<br />
recommendations conta<strong>in</strong>ed <strong>in</strong> previous advice offered to<br />
<strong>the</strong> IJC. The sources of that advice are outl<strong>in</strong>ed follow<strong>in</strong>g<br />
<strong>the</strong> recommendations. The prelim<strong>in</strong>ary recommendations<br />
are limited to those <strong>the</strong> SAB believes are most<br />
relevant to <strong>the</strong> current review and possible revision of <strong>the</strong><br />
Agreement, and particularly Annex 16 on groundwater:<br />
1. Amend or extend Annex 16 <strong>in</strong> view of current<br />
scientific understand<strong>in</strong>gs, call<strong>in</strong>g on <strong>the</strong> Parties to:<br />
a. Recognize and reflect <strong>the</strong> relationship between<br />
<strong>the</strong> quantity and <strong>the</strong> quality of groundwater and<br />
<strong>the</strong> <strong>in</strong>teractions between groundwater and surface<br />
water <strong>in</strong> respect to both quality and quantity.<br />
b. Require systematic, ongo<strong>in</strong>g, bas<strong>in</strong>-scale collection<br />
of data follow<strong>in</strong>g standardized protocols about<br />
quantity and quality trends <strong>in</strong> groundwater.<br />
c. Ma<strong>in</strong>ta<strong>in</strong> water budgets for <strong>the</strong> bas<strong>in</strong> that <strong>in</strong>clude<br />
major groundwater withdrawals and consumptive<br />
uses, and provide frequent reports concern<strong>in</strong>g<br />
trends.<br />
d. Support research on spatial and temporal variation<br />
<strong>in</strong> recharge to groundwater, <strong>the</strong> status of groundwater<br />
resources and <strong>the</strong> role of groundwater<br />
recharge, storage and discharge <strong>in</strong> ecosystem functions<br />
of <strong>the</strong> bas<strong>in</strong>.<br />
e. Recognize <strong>the</strong> importance of groundwater as a<br />
source of dr<strong>in</strong>k<strong>in</strong>g water <strong>in</strong> <strong>the</strong> bas<strong>in</strong> and, <strong>the</strong>refore,<br />
<strong>the</strong> high priority that should be given to<br />
protection of groundwater through monitor<strong>in</strong>g,<br />
wellhead protection, well registration and abandoned<br />
well closure programs to ensure protection<br />
of human health.<br />
f. Develop fund<strong>in</strong>g sources to support groundwater<br />
monitor<strong>in</strong>g, <strong>the</strong> cont<strong>in</strong>ued operation of programs<br />
for <strong>the</strong> protection and remediation of groundwater,<br />
and research activities.<br />
2. Implement concrete plans to meet Party commitments<br />
under Annex 16, <strong>in</strong>clud<strong>in</strong>g:<br />
a. Designat<strong>in</strong>g lead agencies responsible for <strong>the</strong><br />
implementation of Annex 16.<br />
b. Produc<strong>in</strong>g a public agreement between <strong>the</strong> Parties’<br />
lead agencies for standardization of mapp<strong>in</strong>g,<br />
sampl<strong>in</strong>g and analytical protocols for use <strong>in</strong> monitor<strong>in</strong>g<br />
contam<strong>in</strong>ation <strong>in</strong> groundwater of <strong>the</strong> <strong>Great</strong><br />
<strong>Lakes</strong> Bas<strong>in</strong>.<br />
c. Based on <strong>the</strong>se protocols, report<strong>in</strong>g at regular <strong>in</strong>tervals<br />
on <strong>the</strong> sources and quantities of contam<strong>in</strong>ants<br />
enter<strong>in</strong>g groundwater and <strong>the</strong> <strong>Great</strong> <strong>Lakes</strong> through<br />
groundwater.
