In applying <strong>the</strong> Victorian Charter of Human Rights and Responsibil<strong>it</strong>ies 2006 w<strong>it</strong>h<br />

respect to people who show <strong>behaviour</strong>s of concern we have a responsibil<strong>it</strong>y to ask<br />

ourselves <strong>the</strong> following questions when considering whe<strong>the</strong>r to subject <strong>the</strong> person<br />

to restrictive interventions.<br />

• Which <strong>right</strong> is to be lim<strong>it</strong>ed? Is <strong>the</strong> <strong>right</strong> very important in international law?<br />

(e.g. freedom <strong>from</strong> torture)<br />

• Is <strong>the</strong> purpose for wanting to lim<strong>it</strong> <strong>the</strong> human <strong>right</strong>s very important to society?<br />

• What sort of lim<strong>it</strong>ation is being imposed? How could <strong>it</strong> infringe human <strong>right</strong>s?<br />

• Is <strong>the</strong> lim<strong>it</strong>ation likely to achieve <strong>the</strong> purpose? Is <strong>the</strong> lim<strong>it</strong>ation excessive or out<br />

of proportion to <strong>it</strong>s purpose?<br />

• Are <strong>the</strong>re any less restrictive means reasonably available to achieve <strong>the</strong> purpose<br />

that <strong>the</strong> lim<strong>it</strong>ation seeks to achieve?<br />

3. What sort of lim<strong>it</strong>ation is being imposed: How could <strong>it</strong> infringe human <strong>right</strong>s?<br />

4. Is <strong>the</strong> lim<strong>it</strong>ation likely to achieve <strong>the</strong> purpose? Is <strong>the</strong> lim<strong>it</strong>ation excessive or out of<br />

Scenario one<br />

John is a young man w<strong>it</strong>h autism who speaks occasionally in short phrases. He lives w<strong>it</strong>h<br />

three o<strong>the</strong>r men in shared <strong>support</strong>ed accommodation, two of <strong>the</strong> men are dependent on<br />

activ<strong>it</strong>ies of daily living. John requires a moderate level of supervision in most activ<strong>it</strong>ies of<br />

daily living (e.g. how to prepare a meal). He is subject to chemical restraint, Respiradone, for<br />

his autism.<br />

There is a pattern of unauthorised leave described by staff as ‘absconding’. At times he<br />

‘disappears’ overnight and is usually found by <strong>the</strong> police. However when he returns <strong>the</strong>re is<br />

no evidence of injury and he appears safe. He has absconded many times before and has<br />

returned safely.
