INSPECTION TRACKING SYSTEM <strong>HANDBOOK</strong> CHAPTER 4<br />

Checks may be r<strong>and</strong>omly conducted for compliance with §§ 75.400 (Accumulation of<br />

combustible materials) <strong>and</strong> 75.403 (Maintenance of incombustible content of rock dust)<br />

during Section 103(i) spot inspections at mines selected for such inspections due to<br />

excessive methane liberation, methane hazards, or ignitions if the inspector decides<br />

such samples are necessary.<br />

Documentation Required: The inspector shall document the location <strong>and</strong> results of air<br />

readings in the narrative portion of the inspection notes.<br />

I. Accident Investigations. Procedures for formal reports of accident investigations are<br />

covered in the Accident/Illness Investigations Procedures H<strong>and</strong>book. Reports<br />

required in addition to the formal report will contain the citations <strong>and</strong> orders issued<br />

during the accident investigation for violations that contributed to the cause of the<br />

accident. Also, Section 103(j) or 103(k) orders issued during the investigation are to be<br />

included in the accident report. All other citations <strong>and</strong> orders issued that are not pertinent<br />

to the cause of the accident shall be included in a separate report, usually a spot<br />

inspection report. (Refer to Part 50 Direct Final Rule: 74 Fed. Reg. 68918 (Dec. 29, 2009)<br />

for additional information.)<br />

Issuance of Citations for Failure to Immediately Notify <strong>MSHA</strong> of an Accident<br />

Under § 50.10:<br />

Violations for failure to immediately notify <strong>MSHA</strong> of accidents, as defined in<br />

§ 50.2(h), may not be cited under § 50.10 alone. Instead, violations of § 50.10 must be<br />

cited using one of the following paragraphs:<br />

1. § 50.10(a) for accidents involving death of an individual at the mine;<br />

2. § 50.10(b) for accidents involving injury of an individual at the mine which has a<br />

reasonable potential to cause death;<br />

3. § 50.10(c) for accidents involving entrapment of an individual at the mine which<br />

has a reasonable potential to cause death; or<br />

4. § 50.10(d) for any other accident [which would include an entrapment of an<br />

individual at a mine for more than 30 minutes <strong>and</strong> accidents defined in<br />

§ 50.2(h)(4) through (12)].<br />
