appropriate citation or order shall be issued to the mine operator. If warranted, a<br />
Section 107(a) imminent danger withdrawal order shall also be issued to the mining<br />
company.<br />
R. Mining Sites, Milling Operations <strong>and</strong> Plants. An <strong>MSHA</strong>/OSHA (Occupational<br />
<strong>Safety</strong> <strong>and</strong> <strong>Health</strong> Administration) Interagency Agreement regarding jurisdiction over<br />
milling is currently in effect. Inspection personnel should be familiar with the<br />
agreement. Should a question on jurisdiction develop, refer to <strong>MSHA</strong>’s Program<br />
Policy Manual, PPM Volume 1, Section 4. If additional guidance is needed, the matter<br />
should be documented <strong>and</strong> brought to the attention of the immediate supervisor or<br />
District Manager.<br />
S. Explosives. Compliance inspections of explosives storage facilities on mine property<br />
shall be conducted to determine if the facilities meet the requirements of the<br />
Commerce in Explosives st<strong>and</strong>ards (27 CFR Part 555, Subpart K – Storage). (Refer to<br />
the ATF Federal Explosives Law <strong>and</strong> Regulations Title 27 Part 555 ATF Publication<br />
5400.7, List of explosive Materials, <strong>and</strong> ATF Telephone List for additional information.)<br />
§§ 77.2(e)(4) (Definitions) <strong>and</strong> 77.1304(a) (Blasting agents; special provisions) reference<br />
the former Bureau of <strong>Mine</strong>s Information Circular IC 8179 <strong>and</strong> IC 8746 (revision to IC<br />
8179) “<strong>Safety</strong> Recommendations for Sensitized Ammonium Nitrate Blasting Agents.”<br />
Where surface mines are close to underground operations, an inspection shall be<br />
conducted for any danger surface mining may present to underground miners. This<br />
includes shaft <strong>and</strong> slope sinking operations connected to underground mines <strong>and</strong><br />
surface blasting directly over or adjacent to underground mine workings.<br />
The inspector shall:<br />
1. Inspect records of licensees <strong>and</strong> permittees under <strong>MSHA</strong> jurisdiction;<br />
2. Inspect storage facilities where explosive materials are stored;<br />
3. Document noncompliance or compliance on ATF E-ATF Form 5030.5 or ATF<br />
5030.5 (revised 2005) <strong>and</strong> (ATF E-ATF Form 5400.5 or ATF Form 5400.5 Report of<br />
Theft or Loss-Explosive Materials (revised March 2008)); <strong>and</strong><br />
4. Promptly notify a mine supervisor or manager of any noncompliance.<br />
As a precaution against the use of deteriorated or damaged explosives, the inspector<br />
should check with mine operators concerning explosive materials they have<br />
purchased. If there is any indication that explosives recently purchased were in a<br />
Release 1 (February 2013) 4-15
