GENERAL COAL MINE INSPECTION PROCEDURES AND<br />

INSPECTION TRACKING SYSTEM <strong>HANDBOOK</strong> CHAPTER 4<br />

shall be identified by the mine name <strong>and</strong> mine identification number. The cover of<br />

the file shall have a label stating: "May contain personally identifiable medical or<br />

other sensitive information-- Authorized Users Only."<br />

2. Storage of information. Information shall be stored in a locked file cabinet, safe, or<br />

secure room when not being reviewed.<br />

3. Authorized users. Access to the information shall be limited to persons whose<br />

official duties require them to work with such information, but may include<br />

persons who have a need to know the information to perform related duties.<br />

4. Access control system. A log or other method shall be used to identify persons<br />

who have access to the information <strong>and</strong> to account for removal of information from<br />

the stored area.<br />

5. Safeguarding during transport. Persons shall maintain control of the information<br />

during transport <strong>and</strong> shall protect the information from unauthorized or<br />

unintentional access, disclosure, modification, or destruction.<br />

Preparation <strong>and</strong> Distribution of Audit Results. The preparation of audit results <strong>and</strong><br />

findings will include input <strong>and</strong> cooperation from all audit members. The auditors will<br />

furnish a copy of audit results to the District Manager. A review <strong>and</strong> discussion will<br />

be held if necessary. A copy of the audit results will be filed with background data<br />

<strong>and</strong> relevant documentation on the audit.<br />

The District Manager will send a copy of the completed audit to the Chief, OIEI. (Refer<br />

to the PC-7014 Yellow Jacket Pt 50 Q&As; Part 50 Accident Rep.: 74 Fed. Reg. 68918<br />

(Dec. 29, 2009); <strong>and</strong> Part 50: 75 Fed. Reg. 21990 (April 27, 2010) for further guidance<br />

<strong>and</strong> additional information.)<br />

P. Hazardous Condition Complaint Inspections. Hazardous conditions complaints<br />

(HCC) whether classified as Section 103(g) or “Other” hazardous condition complaints<br />

are a necessary part of the safety <strong>and</strong> health effort <strong>and</strong> must be addressed in a manner<br />

consistent with the seriousness of the complaint. The Hazard Complaint Procedures<br />

H<strong>and</strong>book establishes procedures for addressing hazardous condition complaints.<br />

Inspectors <strong>and</strong> specialists must follow the procedures established by the Hazard<br />

Complaint Procedures H<strong>and</strong>book when investigating hazardous condition complaints.<br />

The <strong>Mine</strong> Act <strong>and</strong> 30 CFR Part 43 require <strong>MSHA</strong> to perform an immediate inspection<br />

of a mine when any communication from a miner, representative of the miners, or<br />

other party alleging an imminent danger, a violation of a m<strong>and</strong>atory safety or health<br />
