GENERAL INSPECTION PROCEDURES <strong>HANDBOOK</strong> CHAPTER 3<br />

75.337(e)(1) (Construction <strong>and</strong> repair of seals) requires the mine operator to<br />

notify the District Manager between 2 <strong>and</strong> 14 days prior to commencement of<br />

seal construction. An inspection, which may coincide with a quarterly<br />

inspection, a Section 103(i) spot inspection, or other inspection type events<br />

must be conducted during construction of each set of seals. This construction<br />

inspection will assist in determining the mine operator’s compliance with<br />

<strong>MSHA</strong>’s existing seals st<strong>and</strong>ard <strong>and</strong> the mine’s ventilation plan including:<br />

1. Proper site preparation;<br />

2. Sealed area preparation;<br />

3. Seal construction;<br />

4. Training;<br />

5. Examinations;<br />

6. Recordkeeping including certifications; <strong>and</strong><br />

7. Any other requirements specified in the approved ventilation plan.<br />

§ 75.337(e)(2) (Construction <strong>and</strong> repair of seals) includes a requirement for the<br />

mine operator to notify the District Manager in writing within five days of<br />

completion of a set of seals. After construction is completed, seals must be<br />

inspected by <strong>MSHA</strong> during the next regular inspection. The focus of the<br />

inspection of newly completed seals should be to determine the mine<br />

operator’s compliance with the requirements of <strong>MSHA</strong>’s existing seals<br />

st<strong>and</strong>ard <strong>and</strong> the mine’s ventilation plan, including:<br />

1. Seal construction;<br />

2. Quality control tests;<br />

3. Certifications;<br />

4. Examinations;<br />

5. Post-sealing ventilation;<br />

6. Rock-dusting;<br />

7. Sampling pipes <strong>and</strong> water drainage system;<br />

8. Roof support; <strong>and</strong><br />

9. Any other requirements specified in the approved ventilation plan.<br />

Documentation Required: Each set of seals inspected under this procedure should be<br />

listed in the inspection notes <strong>and</strong> include the name, location, <strong>and</strong> the number of seals<br />

in the set.<br />

14. Track <strong>and</strong> Off-Track Haulage Roads. The inspector shall review the mine<br />

operator’s examination of track <strong>and</strong> off-track haulage roads to assure the mine<br />

operator is examining all haulage roads. The inspector will assure all haulage<br />

roads required to be examined are maintained <strong>and</strong> identified in the ITS. Each<br />

haulage road shall be inspected, for compliance with applicable st<strong>and</strong>ards, <strong>and</strong><br />
