INSPECTION TRACKING SYSTEM <strong>HANDBOOK</strong> CHAPTER 4<br />

J. Petitions for Modification Investigations. The procedures for investigating <strong>and</strong><br />

processing Section 101(c) petitions for modification are found in the Petitions for<br />

Modification H<strong>and</strong>book.<br />

K. Special Investigations. Procedures for special investigations are found in the Special<br />

Investigations Procedures H<strong>and</strong>book. Instruction on filling out Possible<br />

Knowing/Willful Violation Review form, <strong>MSHA</strong> Form 7000-20, can be found in this<br />

h<strong>and</strong>book. (Refer to 7000-20 Possible Knowing/Willful Instructions for further<br />

guidance on filling out the form.)<br />

Note: Only a violation of a m<strong>and</strong>atory health or safety st<strong>and</strong>ard or order issued under<br />

the <strong>Mine</strong> Act, or MINER Act of 2006 shall be reviewed for possible further action. This<br />

includes violations of 30 CFR Parts 47, 48, 49, 50 (for 50.10 only), 62, 70, 71, 72, 75, 77,<br />

<strong>and</strong> 90. The inspector <strong>and</strong> their supervisor shall first review each citation or order to<br />

ensure that the violation has been properly cited.<br />

L. Technical Investigations. Technical investigations are similar to spot inspections<br />

because the investigations are directed to a specific purpose or subject. Detailed<br />

reports of tests, observations, <strong>and</strong> conditions must also be maintained in the UMF,<br />

Special Attention Areas, for as long as they are applicable.<br />

Transmittal of Technical Support Reports with Recommendations for <strong>Mine</strong><br />

Operators:<br />

1. Immediately following a Technical Support investigation at a mine site resulting in<br />

recommendations for the mine operator, a close-out meeting will be held with mine<br />

management <strong>and</strong> the miners’ representative to discuss the preliminary results.<br />

2. Technical Support on-site investigation reports containing recommendations to the<br />

mine operator will be sent to the District Manager <strong>and</strong> the Chief of <strong>Safety</strong>, Coal.<br />

The District Manager will transmit the report to the mine operator <strong>and</strong> miners’<br />

representative. Delivery will be documented.<br />

3. Requests for Technical Support investigations will come from the District Manager<br />

or the Chief of <strong>Safety</strong>, Coal to the appropriate Technical Support Center Chief. The<br />

District Manager will notify the Chief of <strong>Safety</strong> when Technical Support assistance<br />

has been requested.<br />

4. A copy of the report will be placed in the mine file.<br />
