shall be designated by the superintendent or foreman to be at their<br />

proper places from the time that persons begin to descend, until all<br />

the persons who may be at the bottom of said shaft or slope when<br />

quitting work shall be hoisted. Such headman and footman shall<br />

personally attend to<br />

the signals and see that the provisions of this<br />

act, in respect to lowering and hoisting persons in shafts or slopes,<br />

shall be complied with.<br />

Rule 41. No person, except the man giving the signal, shall jump<br />

on a car, cage or gunboat after the signal to start has been given,<br />

and if any person should enter a car, cage or gunboat in excess of<br />

the lawful number the headman or footman shall notify him of the<br />

fact and request him to get off, which request must be immediately<br />

complied wil li Vny violation of this rule must be reported promptly<br />

to the mine foreman.<br />

Rule 42.<br />

An empty trip shall be hoisted iu any shaft or slope where<br />

the engine has been standing idle for an hour or more, before men<br />

are hoisted or lowered in said shafts or slopes, and no person or persons<br />

shall ascend any shaft or slope when working on the night turn,<br />

until one trip shall first be hoisted therein.<br />

Rule 43. Every passage-way used by persons in any mines and<br />

also used for transportation of coal or other material, shall be made<br />

of sufficient width to permit persons to pass moving cars with<br />

safety, but if found impracticable to make any passage-way of sufficient<br />

width, then holes of ample dimensions, and not more than one<br />

hundred and fifty (150) feet apart, shall be made on one side of said<br />

passage-way. The said passage-way and safety holes shall be kept<br />

free from obstructions and shall be well drained;<br />

the roof and sides<br />

of the same shall be made secure.<br />

Rule 44. When locomotives are used in any mine their speed shall<br />

not exceed six (6) miles per hour, and an efficient alarm shall be provided<br />

and attached to the front end of every train of cars pushed by<br />

a locomotive in anj mine or part of a mine.<br />

Rule 45. Locomotives propelled by steam, if using fire, shall not be<br />

used in any passage-way which is also used as an intake air-way to<br />

any mine or part of a mine where persons are employed, unless there<br />

be a suffiecient quantity of air circulating therein to maintain a<br />

healthy atmosphere.<br />

Rule 46. No person shall couple or uncouple loaded or empty cars<br />

while the same are in motion: Provided however, That this shall not<br />

apply to the top or bottom men of slopes, planes or shafts.<br />

Rule 47. When cars are run on gravity roads by breaks or sprags,<br />

the runner shall only ride on the rear end of the last car, and when<br />

said cars are run by sprags, a space of not less than two (2) feet from<br />

the body of the car shall be made on one or both sides of the tracK<br />

wherever it may be necessary for the runner to pass along the sside
