deceased was on his way out of the mine with a trip of loaded cars,<br />

and when near the entrance the front car left the track, the deceased<br />

being on the front of the first car, tried to unhitch the mule, and before<br />

he could get out of the way the car caught him. as stated<br />

above.<br />

Benjamin Simcoe, miner, was instantly killed in Gallatin mine<br />

November 5, by a fall of roof and side. The deceased and John<br />

Ouchie was on their way out of the mine, and on reaching a point<br />

near an entry known as ''Old No. 17." a fall occurred which measured<br />

74 feet long, 16 feet wide and about 5 feet in depth. The mine<br />

the morning of the acci-<br />

officials say that the place was examined in<br />

dent and no unusual danger discovered. An inquest was held and<br />

verdict of accidental death rendered.<br />

Michael G. Santo, miner, was fatally injured in Coal Bluff mine,<br />

November 7th, by a fall of slate.<br />

James Paskerella, miner, was instantly killed in Manown mine,<br />

November 9th, by a fall of roof. Subsequent investigation showed<br />

that there had been two posts set under the roof, but they had<br />

been broken by the roof falling. It seemed that the roof must<br />

have given signs of its dangerous character previous to giving away<br />

had a proper examination been made by Paskerella and his partner<br />

Frank Bevetta before it fell.<br />

John Hurra, miner, was instantly killed in Vigilant mine November<br />

loth, by a fall of slate. At the time of the accident the deceased<br />

was "blocking" his "bearing in." The slate fell out in the form<br />

of a "pot." On examination of the place I am of opinion that this<br />

accident was unavoidable.<br />

Silas Lear, Joseph Novak and John Capritch lost their lives<br />

in an<br />

Leopold Bastian, miner, was instantly killed in Vesta No. 1 mine<br />

November 21st, by a fall of roof. The deceased was running a<br />

mining machine at the time of the accident. The roof w as sounded<br />

a few minutes before it fell and was considered safe.<br />

Frank Markella, miner, was instantly killed in Rostraver mine<br />

November 23d, by a fall of slate. The deceased was loading a car<br />

;it the time of the accident. There was a great deal of trouble in<br />

the room where the accident occurred by "pots" and rolls,<br />

and as<br />

a consequence it was necessary to use caution in working it. It<br />

was in evidence that the slate had not been examined or sounded<br />

for some time before it fell.<br />

Joseph Rutoskey, loader, was fatally injured in Bunola mine December<br />

3d, by a fall of slate. lie was loading a car at the time of<br />
