ENDNOTES FOR SECTION I 41 <strong>The</strong> <strong>Panel</strong>’s charter calls for the <strong>Panel</strong> to make a thorough, independent and credible assessment of the effectiveness of BP Products NorthAmerica Inc.’s corporate oversight of safety management systems at its five U.S. refineries and its corporate safety culture. BP is a large andcomplex organization comprised of various corporate entities that own and operate assets in countries throughout the world. <strong>The</strong> complexity ofthe organization affects the manner in which the company oversees its businesses, as well as its corporate culture. Executive management forBP p.l.c., executive management for the Refining and Marketing segment, and the most senior line management for Refining are located inLondon. Because these levels of management affect corporate oversight and corporate culture relating to BP’s U.S. refineries, the <strong>Panel</strong> alsoconsidered the effect of such management on oversight and culture. This report refers generically to “BP,” not in reference to particular legalentities, but rather for convenience to include all parts of the BP organization that have some operational, managerial, or oversight involvementwith BP’s U.S. refineries. By such generic references, the <strong>Panel</strong> does not intend to attribute legal significance to statements made to anyparticular entities.2 <strong>The</strong> CSB, which is authorized by the Clean Air Act Amendments of 1990, is a federal agency charged with investigating industrial chemicalaccidents, including the review of the effectiveness of federal regulations and regulatory enforcement. Designed by Congress to beindependent, the CSB is not a regulatory agency. Rather it collaborates with OSHA, the EPA, and other federal agencies in investigationspursuant to memorandums of understanding.3 This report uses “HSSE” (Health, Safety, Security, and Environment) and “HSE” (Health, Safety, and Environment) interchangeably. Over time,BP has transitioned from using “HSE” to using “HSSE,” and the documents provided to the <strong>Panel</strong> use both acronyms.4 <strong>The</strong> endnotes in this report cite only to publicly available documents or sources.<strong>The</strong> <strong>Panel</strong>’s Review C 16
