| Chamber in Review 活 動 重 溫 |零 售 及 旅 遊 委 員 會2 011 年 初 , 政 府 發 表 有 關 「 打 擊 不 良 營 商 手 法 , 立 法 保 障 消費 權 益 」 的 諮 詢 , 涉 及 預 繳 服 務 和 誤 導 廣 告 。 我 們 於 3 月 與商 務 及 經 濟 發 展 局 副 秘 書 長 會 面 , 提 出 我 們 的 關 注 , 特 別 是 條 例草 案 建 議 引 入 的 新 增 罪 行 , 不 但 未 有 明 確 界 定 不 良 行 為 , 而 且 涵義 廣 泛 、 含 糊 , 容 易 觸 及 正 常 的 商 業 活 動 。除 非 有 關 罪 行 的 適 用 範 圍 只 列 明 局 限 於 不 良 行 為 , 否 則 只 會窒 礙 企 業 , 為 市 場 引 入 創 新 的 產 品 和 服 務 , 以 免 觸 犯 法 例 。 這 將有 利 於 知 名 的 大 型 品 牌 , 卻 不 利 於 中 小 企 。 我 們 亦 認 為 , 詳 細 的實 施 指 引 應 在 條 例 草 案 通 過 之 前 公 布 。 委 員 會 將 繼 續 監 察 有 關 立法 審 議 。去 年 , 我 們 邀 請 不 同 政 府 部 門 的 官 員 , 就 影 響 業 界 的 措 施 與委 員 會 成 員 交 流 意 見 。 我 們 亦 就 「 擴 大 塑 膠 購 物 袋 環 保 徵 費 計劃 」 的 公 眾 諮 詢 , 與 環 境 保 護 署 的 官 員 分 享 我 們 的 看 法 。 委 員 會的 意 見 已 反 映 於 總 商 會 一 份 建 議 書 內 , 對 政 府 擴 大 向 所 有 零 售 商徵 費 , 以 維 持 公 平 競 爭 環 境 的 建 議 , 表 示 歡 迎 。 為 減 少 零 售 商 ,特 別 是 中 小 企 要 遵 循 法 例 產 生 的 成 本 和 不 必 要 的 行 政 成 本 , 我 們建 議 政 府 考 慮 取 消 要 求 零 售 商 就 膠 袋 徵 費 發 出 收 據 或 備 存 紀 錄 。委 員 會 成 員 還 不 時 就 租 金 成 本 不 斷 上 升 , 以 及 競 爭 法 、 最 低工 資 及 即 將 進 行 的 標 準 工 時 立 法 等 其 他 議 題 , 表 達 強 烈 的 關 注 。這 些 議 題 都 是 委 員 會 成 員 的 關 注 重 點 , 我 們 將 繼 續 監 察 有 關 發展 。旅 遊 業 方 面 , 我 們 與 香 港 旅 遊 發 展 局 緊 密 合 作 , 亦 將 繼 續 發掘 嶄 新 旅 遊 產 品 的 商 機 , 以 及 監 察 酒 店 客 房 的 供 應 。 業 界 的 挑 戰之 一 , 是 技 術 勞 工 供 應 短 缺 。 我 們 將 尋 求 方 案 , 以 確 保 穩 定 供 應優 質 技 術 勞 工 , 協 助 鞏 固 香 港 作 為 地 區 旅 遊 勝 地 。本 文 摘 錄 自 零 售 及 旅 遊 委 員 會 主 席 伍 俊 達 發 表 的 報 告 演 辭 。Legco Report 立 法 會 報 告After more than a year of persistent effort, the Governmentfinally accepted our views and proposed majoramendments to the Competition Bill to address thebusiness sector’s concerns. We welcome these changes as thechances of SMEs inadvertently falling into the law trap havealready been greatly reduced. Last month, the Government alsoraised the turnover threshold to HK$40 million a year. Thismeans 95% of SMEs would be exempt, up from 86% under theoriginal HK$11 million threshold.The Chamber, the business sector and the community havealso been highly concerned about raising the minimum wagefrom HK$28 to HK$35 an hour and legislating standard workinghours. I pointed out that these issues will not only affectthe cost of business operations and labor interests, but alsopose a daunting challenge to the prosperity and stability ofHong Kong society as a whole.The minimum wages has added pressure on many SMEs.The restaurant and bar sector now finds it harder to hire workers.I have raised our concern repeatedly in the LegislativeCouncil that the minimum wage is still a new thing in HongKong and not all effects of the new law have fully manifested.That is why adjustment of the wage and other labor issuesshould not be rushed. And if the society is to develop healthily,the business community needs to be heard.In summary, other measures accepted by the Governmentthat I put forward include:• The “Special Loan Guarantee Scheme” (SpGS), to tideenterprises over the credit crunch problem, was introducedin December 2008.• Following the end of the SpGS, the “SME Financing GuaranteeScheme” took off on January 1, 2011. In responseto my suggestions, the Government refined the existingRetail and Tourism CommitteeIn early 2011, the Government published its consultation on“Legislation to Enhance Protection for Consumers againstUnfair Trade Practices,” which touched on pre-paid servicesand misleading advertising. We met with the Deputy Secretaryfor Commerce and Economic Development in March to raiseour concerns, particularly the proposed new offences in thebill that fail to clearly identify bad conduct. These are so broadand vague that they would catch normal commercialactivities.Unless the offences are clearly restricted to bad conduct,businesses will be deterred from bringing innovative productsand services to market. This will benefit the establishedmajor brands, at the expense of SMEs. We also suggestedthat detailed guidelines on the application of the law should72 June 2012 The Bulletin 工 商 月 刊
