| Talking Points 議 論 縱 橫 |Legco Viewpoint 立 法 會 視 窗「 拉 布 」 損 害 香 港 競 爭 力Filibustering UnderminesHong Kong’s CompetitivenessJeffrey Lam is theChamber’s LegcoRepresentative.林 健 鋒 為 香 港 總 商 會立 法 會 代 表 。By Jeffrey Lam 林 健 鋒With the change of Administration fast approaching,and the current Legco term coming to an end, weall wish to see some long-debated bills enactedso that policies which will help people’s livelihoods and theeconomy can be rolled out smoothly.However, some radical Legislative Council membersintroduced over 1,300 trivial and unnecessary amendmentsto the Legislative Council (Amendment) Bill for their ownpolitical agendas. They hoped to use filibuster tactics to dragdown the bill and stall effective governance. They abusedLegco procedures and stopped attending meetings withoutreason, which resulted in failure to achieve a quorum.Consequently, many subcommittee meetings had to becancelled.The 1,300-plus trivial amendments resulted in a hugewaste of manpower and resources of the Legislative CouncilSecretariat. More importantly, the lawmakers not onlywasted public resources, but also delayed the passing of anumber of major bills concerning Hong Kong’s economyand people’s livelihoods. These include the Inland Revenue(Amendment) Bill related to reductions in salaries tax andrates, the Competition Bill, the Companies Bill and a billregulating the sale of first-hand flats.Even the proposal of the next-term administration toreorganize the government structure may be affected, causingvarious new policies to be delayed. At the end of the day, HongKong’s economic development, the government’s effectivegovernance and the people’s well-being will be affected.The abuse of legal procedures by some lawmakers in thepast delayed many major development projects long enoughto significantly weaken Hong Kong’s competitiveness andinvestor confidence.If another filibustering palaver happens, the Governmentshould adjust the priority of the bills to be scrutinized andvoted on, with priority given to those with an immediateimpact on people’s livelihood and the local economy. ThePresident should also impose more stringent restrictions onspeaking to stop members from ranting on. Undoubtedly, anamendment to the Rules of Procedure to prevent lawmakersfrom proposing numerous unnecessary and minoramendments as well as to limit the number of times they canspeak is the ultimate solution. Various foreign legislaturesalso have in place a mechanism to prevent filibusterattempts. I hope that the next Legco will consider setting upa mechanism to end filibustering while providing adequateprotection of the right to speak.時光 飛 逝 , 新 舊 政 府 換 屆 在 即 , 今 屆立 法 會 亦 快 將 完 結 , 我 們 都 希 望 在屆 滿 前 議 決 一 些 審 議 多 時 的 法 案 ,令 一 些 有 利 民 生 和 經 濟 的 政 策 能 夠 順 利 推出 , 不 用 留 待 下 屆 立 法 會 重 新 審 議 。然 而 , 有 些 反 對 派 議 員 為 了 一 己 政 治 目的 , 對 《 立 法 會 議 員 出 缺 安 排 條 例 草 案 》 作 出過 千 項 咬 文 嚼 字 和 無 聊 瑣 碎 的 修 訂 , 以 圖 利 用「 拉 布 」 戰 將 有 關 法 案 拖 死 , 從 而 癱 瘓 特 區 政府 的 有 效 施 政 。 他 們 不 顧 一 切 濫 用 議 事 程 序 ,並 無 故 缺 席 會 議 , 導 致 立 法 會 會 議 流 會 , 很 多小 組 會 議 也 被 迫 取 消 , 整 個 立 法 會 秘 書 處 的 人力 物 力 都 虛 耗 在 這 一 千 三 百 多 條 無 謂 的 修 訂 當中 。 他 們 浪 費 公 帑 之 餘 , 也 使 多 項 有 關 經 濟 民生 的 重 要 法 案 被 迫 延 遲 表 決 , 包 括 寬 減 薪 俸 稅及 差 餉 的 稅 務 條 例 、 競 爭 法 、 公 司 法 , 以 及 規管 一 手 樓 銷 售 的 法 案 等 。現 在 , 甚 至 連 新 一 屆 政 府 提 出 的 重 組 架 構方 案 也 可 能 受 到 波 及 , 導 致 很 多 新 政 策 延 遲展 開 , 香 港 的 經 濟 發 展 、 政 府 的 有 效 施 政 和市 民 的 福 祉 必 會 受 到 牽 連 。 事 實 上 , 過 去 因為 某 些 議 員 濫 用 司 法 程 序 , 令 很 多 大 型 發 展項 目 大 幅 滯 後 , 導 致 香 港 競 爭 力 大 受 影 響 。假 若 投 資 者 看 到 香 港 經 濟 政 策 不 能 順 利 推行 , 可 能 會 對 香 港 的 投 資 失 去 信 心 , 另 投 他方 。事 到 如 今 , 當 務 之 急 是 要 阻 止 拉 布 的 骨 牌效 應 惡 化 下 去 。 假 如 再 有 新 一 輪 的 拉 布 行動 , 政 府 應 調 整 提 交 法 案 的 先 後 次 序 , 先 行表 決 其 他 對 民 生 和 經 濟 更 有 迫 切 性 的 法 案 。此 外 , 主 席 應 對 議 員 的 發 言 作 出 更 嚴 厲 的 管制 , 限 制 他 們 作 出 與 條 例 無 關 的 發 言 。 當然 , 通 過 修 改 議 事 規 則 , 防 止 議 員 提 出 大 量無 聊 、 瑣 碎 的 修 訂 和 對 發 言 次 數 設 限 才 是 最終 的 解 決 方 法 , 外 國 不 少 立 法 機 關 也 有 設 立防 止 拉 布 的 機 制 。 我 希 望 下 屆 立 法 會 能 夠 在保 障 議 員 充 分 的 發 言 權 下 , 研 究 如 何 堵 塞 議員 惡 意 拉 布 的 機 制 。www.jeffreykflam.com6 June 2012 The Bulletin 工 商 月 刊
