Appendix 6 IndividualAssessment of Need ProtocolProtocol to govern arrangements <strong>for</strong> cooperation by the Health Service Executive<strong>with</strong> housing authorities in relation to the development and coordination of theservices provided by housing authorities <strong>for</strong> persons <strong>with</strong> disabilities, aged under5 years, who have been identified by the Health Service Executive under theAssessment of Need process consistent <strong>with</strong> Section 8 of the <strong>Disability</strong> Act 2005,and made known to the housing authorities under the provisions of Section 12 ofthe <strong>Disability</strong> Act, 2005• Where a person (aged under 5 years of age) has been assessed under Section 8 ofthe <strong>Disability</strong> Act 2005, which commenced on 1 June 2007, and has been identifiedas likely to require housing support, a Liaison Officer 125 , established under Section 11of the <strong>Disability</strong> Act 2005, shall refer the person to the Director of Services of the<strong>Housing</strong> Section of the relevant <strong>Housing</strong> Authority, <strong>for</strong> the purpose of facilitating thedetermination of any housing service that the <strong>Housing</strong> Authority considers the personto be entitled to.• An Assessment Officer, established under Section 8 of the <strong>Disability</strong> Act 2005, mayrefer a person <strong>with</strong> a disability to the Director of Services of the <strong>Housing</strong> Section ofthe relevant <strong>Housing</strong> Authority, if she or he deems it appropriate that the person,who has been identified as likely to require housing support, is made known to thehousing authority as early as possible following the completion of the assessmentunder Section 8 of the <strong>Disability</strong> Act 2005. In such instances, the Assessment Officershall notify the appropriate Liaison Officer that a referral to the <strong>Housing</strong> Authorityhas taken place.• The Director of Services of the <strong>Housing</strong> Section may designate an appropriate official<strong>for</strong> the purpose of engaging / liaising <strong>with</strong> an Assessment Officer or a Liaison Officer.• Under Section 12 of the <strong>Disability</strong> Act 2005, the Health Service Executive shall, <strong>with</strong>the consent of the individual or, if appropriate, a specified person 126 , provide allrelevant in<strong>for</strong>mation in relation to the housing element of the assessment report,produced under Section 9 of the <strong>Disability</strong> Act 2005, to the relevant <strong>Housing</strong>Authority <strong>for</strong> the purpose of assisting the person <strong>with</strong> a disability in accessing theappropriate housing services provided by the <strong>Housing</strong> Authority.125Liaison officers are known as case managers in the HSE126A specified person means• A spouse, parent or relative of the person <strong>with</strong> a disability;• A guardian or a person acting in loco parentis to the person <strong>with</strong> a disability;• A legal representative of the person <strong>with</strong> a disability; or• A personal advocate assigned by the Citizens In<strong>for</strong>mation Board [<strong>for</strong>merly Comhairle] to represent theperson <strong>with</strong> the disability.153153
